REGULATORY San Joaquin County Environmental Health Department (EHD), as the <br />AUTHORITY Local Enforcement Agency (LEA), is authorized by Division 30 of the <br />Public Resources Code (PRC), Section 43209 and 45000 and Title 14 of <br />the California Code of Regulations (CCR), to enforce applicable solid <br />waste regulations within the Cities and County of San Joaquin. <br />Division 30, Part 5 of the PRC and 14 CCR Sections 18304 and 18304.1 <br />authorizes the LEA to issue enforcement orders for violations of the PRC <br />and regulations adopted pursuant to Division 30. The PRC also <br />authorizes the LEA to assess penalties for failure to comply with the <br />enforcement order. <br />STIPULATION EHD and Respondent enter into this Stipulated Penalty Order as follows: <br />AND ORDER 1. The parties wish to resolve this matter and to ensure prompt <br />action to achieve the Schedule of Compliance below. <br />2. Jurisdiction exists pursuant to Public Resources Code section <br />45010 and 45011. <br />3. Respondent waives the right to appeal in this matter. <br />4. This Order shall constitute full sett <br />lement of the violations alleged <br />in the Notice of Penalty Assessment so long as Respondent fully <br />complies with its terms, but does not limit EHD from taking <br />appropriate enforcement action for other or future violations <br />addressed in the Penalty Order (Attachment 1). <br />5. Respondent agrees to submit immediately to the EHD, for review <br />and approval, a corrective action plan detailing how the site will be <br />brought into compliance. <br />6. Respondent agrees to remove abandoned autos and other solid <br />waste from the site within 180 days of the execution of this <br />Stipulated Order, <br />7. Respondent agrees to grade covered surfaces of the disposal <br />area to promote lateral runoff of precipitation and to prevent <br />ponding within 180 days of the execution of this Stipulated Order, <br />8. Respondent agrees to design and maintain drainage system to <br />ensure integrity of roads, structures, and gas systems and prevent <br />safety hazards and exposure of waste within 180 days of the <br />execution of this Stipulated Order. <br />9. Respondent acknowledges that failure to remedy the <br />aforementioned violations) may result in San Joaquin County <br />and/or the California Department of Resources Recycling and <br />
