The following is an itemized list of hazardous materials violations that have not been <br />addressed for AGS FUEL INC DBA CIRCLE K CHEVRON as of May 05, 2022. <br />Open violations from March 30, 2022 inspection <br />Violation #7 - Failed to electronically submit an adequate ER procedures for a release or threatened release. <br />OBSERVATION: The emergency response(ER) procedures were lacking or inadequate Section A10 did not check <br />hazardous material, it checked only hazardous waste, both programs need to be checked. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: <br />- immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />- procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />- evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />httpalcers.calepa.ca.govl, upload the correct or updated information, and submit to the EHD for approval. <br />Z 'ZZ <br />* This violation was corrected ❑ This violation will be corrected by (date) <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />Z <br />Violation #8 - Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was not submitted for 2020, 2021 and 2022. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response pians and procedures in the event of a release or <br />threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTIONS Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at httpalcers.calepa.ca.gov/, upload the correct or updated information, <br />nnri suhmit to the EHD for aeoroval. <br />* This violation was corrected <br />❑ Supporting documents included <br />Describe acti <br />❑ This violation will be corrected by (date): <br />taken or will be taken to correct violation: <br />Page 1 of 2 <br />
