Comm. Gabbard commented on the train traffic. He said he recently <br /> made numerous trips in that area and was never held up by the train. <br /> Bud Corwin spoke in favor of the project. He said he lives in the area <br /> and the odor from the processing plants in the vicinity is not a <br /> problem to him. <br /> Mr. Thomsen said he lives adjacent to the property to be divided and <br /> has lived in the area for approximately 50 years. He said he had no <br /> objection to the project. He said there is a truck traffic hazard <br /> going into Ace Tomato and California Hotwood, however, he did not <br /> think the residential traffic would create additional problems . He <br /> said that someday he might also want to subdivide his 17 acres of <br /> land. Mr. Thomsen said that people in the area cannot make a living <br /> by farming on a 40 acre parcel of land. He said there are residential <br /> apartments in the area. Regarding odors, he said he does not get odor <br /> from Ace Tomato or the Briners and that these are seasonal operations. <br /> He said he occasionaly gets odors from the winery. <br /> Sam Loduca said that there have been odors from the winery. Pulp is <br /> being dumped and he is concerned over pollution to the groundwater . <br /> Bill Houk, Oakdale Construction Company, said that the old subdivision <br /> consisted of legal lots and the applicant can apply for a Certificate <br /> of Compliance. <br /> OPPONENTS: Mr. Herum again spoke in opposition. <br /> Anthony Indelicato spoke in opposition to the development. Although <br /> this winery does crush grapes, the Gallo Winery in Manteca does not. <br /> However, the winery does not mix well with residential development. <br /> The mixed land uses will create complaints. The winery has been there <br /> for 54 years and there is a move to subdivide the surrounding land. <br /> Mr. Hutchison, French Camp Road, Manteca, said he was held up by a <br /> train on the way to this hearing. The train parks in front of his <br /> home. The traffic does back up to the intersection many times. There <br /> are from two to four trains per day. <br /> Mr. Herum commented that he did not think these were recognized lots <br /> under the San Joaquin county Ordinance because there is not a <br /> recognized and approved right-of-way. Mr. Herum reiterated his pre- <br /> vious testimony. He said this would be fragmentation of land in an <br /> agricultural zone. It encourages further divisions in the area. <br /> REBUTTAL: Monte Seibel said that the Subdivision Map Act recognized <br /> these lots for sale, lease and financing. The right-of-way was dedi- <br /> cated many years ago, for those lots and with the subdivision map. <br /> Comm. Bozzano said he had a telephone conversation with George Lagorio <br /> and he submitted a letter.
