The training program can not say "exempt". Change to say <br />provided elsewhere in CERS under the" emergency response and contingency" section. Discard the Miscellaneous <br />State Required documents file. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br />threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, <br />and submit to the EHD for approval. <br />This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business plan has not ben <br />submitted for the years of 2020, 2021, and 2022. The last submittal was made on 11/20/2018 for the year of 2019. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted in-office Hazardous Materials Business Plans (HMBP) inspection. The food inspector, Nick <br />Wiseman, performed an on-site inspection for the CO2 tank on 3/3/2021. <br />There were 4 violations found during the in-office inspection. complete and submit a copy of the Return to <br />Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or <br />will be taken for each violation, and any supporting paperwork, by 6/5/2022. <br />Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152).
