PLANNING COMMISSION MINUTES <br /> OCTOBER 6 , 1988 <br /> 4. MINOR SUBDIVISION APPLICATION NO. MS-89-5 OF MARY WALTERS (C/O DON <br /> MOYER ASSOCIATES ) to subdivide a 24.1-acre parcel into two parcels of <br /> 3 . 0 acres and 21. 1 acres in size. The property is located on the <br /> east side of State Route 99, approximately one mile south of <br /> French Camp Road, north of Manteca. (Supervisorial District 5 ) <br /> Kitty Walker, Senior Planner, introduced a staff report into the <br /> record. <br /> Chairman Bozzano said he wished to disclose that he had some conver- <br /> sation with the applicant's agent concerning this application. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Don Moyer, representing this application, said he did <br /> discuss this project with Chairman Bozzano. Mr. Moyer said there are <br /> two points for consideration: <br /> Is the use reasonable? <br /> ° Can this project be approved within the bounds of the law? <br /> Mr. Moyer went on to say that the intent of the ordinance is that <br /> people who have roots in the farm land can remain there. Mary <br /> Walters ' father passed away in 1981 and left this property to her. If <br /> the Commission can find that Ms. Walters is an owner/operator, there <br /> would be no problem in obtaining approval of this application. The <br /> property has been in the family since World War I. Ms. Walters <br /> inherited the property and lives there by herself. She has had <br /> numerous robberies and would like to have her half-sister and her <br /> family build a home on the proposed new parcel. This would enable Ms. <br /> Walters to have a close neighbor which would discourage robbers from <br /> breaking into her home; otherwise, Ms. Walters will have to move to <br /> the city for her own protection. <br /> Mr. Moyer said the southerly third of the property is not leased. The <br /> weeds have to be disced. She pays the fee for irrigation of the pro- <br /> perty. She meets the spirit of the ordinance if not the technical <br /> criteria. She is on the property every day and is responsible for the <br /> day-to-day control of the southerly 1/3 of the property. Nothing is <br /> farmed on that portion of the parcel. It is fallow ground. <br /> Terry Lewallen, 1242 Slayton Drive, Manteca, said that she is Ms. <br /> Walters ' sister and that Ms . Walters is single and lives alone; that <br /> she will be forced to sell the land unless her family can move there. <br /> Mrs. Lewallen said that she has a family and they would like to build <br /> a new home there. <br /> PC: 10/6/88 -3- <br /> MINUTES <br />
