CONDITIONS OF APPROVAL <br /> GX-941 <br /> DON RODGERS <br /> Unless otherwise specified, all Conditions of Approval and Ordinance Requirements shall be <br /> compiled with prior to commencement of grading and/or excavating. <br /> The approval will expire 18 months from the date of approval unless (1) all Conditions of Approval <br /> have been compiled with, (2) all necessary permits have been secured and remain In force, and (3) <br /> all necessary permits from other agencies have been secured and remain In force. <br /> Those conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance Requirements. Ordinance Requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a The average finished grade elevation shall be no lower than 28.75 feet. And, the final <br /> grade shall be limited to that elevation, certified by the South San Joaquin Irrigation <br /> District,which is necessary to provide gravity irrigation to the property.The applicant shall <br /> provide such certification with the required improvement plans. (Development Title <br /> Section 9-1410.3{b}{2} and {4}) <br /> b. All Conditions of Approval shall be complied with and grading shall have commenced <br /> within eighteen (18) months of the date of approval of GX-94-1. Excavation and final <br /> rehabilitation of the site shall be completed within eighteen (18) months of the start of <br /> excavation. (Development Title Section 9-215.14) <br /> C. Excavated material shall be stockpiled on the site and may not be removed from the site <br /> until acceptance of the Certification of Compliance by the Director. Excavated material <br /> shall be stockpiled and set back at least twenty-five (25) feet from any property line or <br /> road right-of-way; or <br /> Secure a performance bond or other financial security sufficient to cover the cost of <br /> rehabilitation of the site for agricultural use. The form of the bond or other financial <br /> security shall be found acceptable by County Counsel. The amount of the security shall <br /> be approved by the Director. (Development Title Sections 9-1410.3[b]{4}{m}) <br /> d. All private roads involved in an excavation shall be maintained so as to control the <br /> creation of dust. (Planning Title Section 9-1410.3{a}) <br /> e. Excavation operations shall not be carried on during the hours from nine(9) p.m.through <br /> five (5) am., except during periods of declared national, state or local emergency. <br /> (Development Title Section 9-1410.3{d}) <br /> f. All emissions shall be subject to the rules and regulations of the San Joaquin Valley <br /> Unified Air Pollution Control District.
