San Joaquin County <br />HHWVAR970804 <br />Page 2 <br />Description of activity for which the variance will be issued: Household hazardous <br />waste (IHiW) collection facilities are authorized pursuant to HSC, section 25218.3(b). <br />California Code of Regulations (Cal. Code of Regs.), section 67450.4 authorizes <br />acceptance of up to a total of 100 kilograms of hazardous wastes from CESQGs per <br />month. However, CESQGs are limited to transporting no more than 5 gallons or 50 <br />pounds of hazardous waste under the small -quantity exemption pursuant to HSC, section <br />25163(c). The variance is requested to allow participating CESQGs to transport up to <br />100 kilograms (220 pounds or 27 gallons) of hazardous waste or 1 kilogram of <br />acutely/extremely hazardous waste to the HHW collection events conducted by San <br />Joaquin County. The CESQG waste will be accepted by appointment only and will be <br />received either at a separate receiving location at the event or at a different time than the <br />H1 -1W collections. Wastes will be transported from small business locations in the county <br />to the collection sites by the individual CESQG or by his employee. At the end of each <br />H1 -1W collection event, wastes will be manifested and transported offsite by registered <br />hauler(s) to facility(les) authorized to receive hazardous wastes for recycling, treatment, <br />and/or disposal. <br />SECTION III. SPECIFIC WAIVER <br />DTSC has determined that the applicant meets the requirements, as outlined in HSC, <br />section 25143, for a waiver from specific regulatory requirements as outlined in <br />Sections II, III and IV of this variance. The specific findings and determinations made by <br />DTSC are as follows: <br />Authority for granting the variance pursuant to HSC, section 25143: The hazardous <br />waste or the hazardous waste management activity is granted a waiver or variance <br />pursuant to the Comprehensive Environmental Response, Compensation and Liability Act <br />(CERCLA) or is -not otherwise regulated pursuant to the Resource Conservation and <br />Recovery Act (RCRA). <br />Based on the review of the evidence provided by the applicant, the hazardous waste and <br />the hazardous waste management activity are insignificant or unimportant as a potential <br />hazard to human health and safety and the environment. <br />It has also been determined that the packaging, labeling and placarding of the hazardous <br />waste and actual transportation on the highways are adequately regulated and enforced by <br />the federal Department of Transportation (DOT), Department of California Highway <br />Patrol (CHP) and the Department of Motor Vehicles and thus will not pose a substantial <br />hazard to human health and safety or the environment. <br />
