San Joaquin County MEP Variance <br />HHWVAR010202 <br />Page 3 <br />Specific Waivers Granted: DTSC has determined that the applicant is waived from <br />the following statutory and/or regulatory requirements for the following specific <br />hazardous waste management activities: <br />The applicant is granted a variance from the requirements of H&SC, Section <br />25218.1 (o), that the MEP materials are reissued concurrent with HHW facility operation. <br />California Environmental Quality Act (CEQA) exclusion. Based on its review of the <br />same evidence, DTSC finds that it can be seen with certainty that there is no possibility <br />that the granting of this variance may have a significant effect on the environment, <br />within the meaning of the Title 22, California Code of Regulations (CCR), Section <br />15061(b)(3). <br />IV. TERMS AND CONDITIONS <br />Conditions for revocation: This variance is subject to review at the discretion of <br />DTSC and may be revoked at any time. DTSC shall revoke this variance if DTSC finds <br />that the provisions as outlined in H&SC, section 25143(c) for variance revocation have <br />been met or on the basis of DTSC policy changes. <br />Specific terms and conditions of this variance: The applicant shall be subject to the <br />following conditions: <br />1. The MEP shall be managed following the procedures indicated in Sections Il, III, <br />and IV of this variance. <br />2. All products/materials shall be screened per a written HHW program quality <br />assurance/quality control plan, required pursuant to H&SC, Section 25218.12(a) and <br />defined in H&SC, Section 25218.10). <br />3. Offsite products/materials identified for reissuance to the MEP shall be packaged <br />per federal DOT regulation prior to transport to the MEP. <br />4. Only persons trained in hazardous waste management including personnel <br />loading or unloading waste from transport vehicles shall be allowed to handle the <br />waste. Job titles, job descriptions, and personnel training records shall be made <br />available on-site for each person handling hazardous waste as specified in CCR, Title <br />22, Section 66264.16(d). <br />
