OBSERVATION: This facility,which is a hazardous waste generator, accepted hazardous waste from an off-site location without a permit to operate a Treatment, Storage, Disposal Facility(TSDF). The following wastes were hauled from 1000 E Roth Rd, French Camp, CA to 833 E Eighth St, Stockton, CA. 1000 E Roth Rd is a staffed site and is not eligible for remote consolidation transfer to 833 E Eighth St. 1. Three 55-gallon drums observed stored at 833 E Eighth St labeled as Hazardous Waste, 1000 E Roth Rd, French Camp, CA, oily water, and accumulation start date 3-10-22. 2. One 55-gallon drum observed stored at 833 E Eighth St labeled as Hazardous Waste, 1000 E Roth Rd, French Camp, CA, oily pads, and accumulation start date 3-10-22. 3. Two 55-gallon drums of waste solids containing flammable liquids,waste codes 352 and D001,transferred from 1000 E Roth Rd to 833 E Eighth St using a shipping paper dated 4-18-22. The drums were unloaded and stored in a fenced storage area at the Eighth St address. The waste was shipped off-site from 833 E Eighth St on 4-21-22 using hazardous waste manifest 022452620JJK. The manifest states that the generator's site address is 1000 Roth Rd. REGULATION GUIDANCE: California Health&Safety Code section 25201(a) (a) Except as provided in subdivisions (c)and (d), no owner or operator of a storage facility, treatment facility, transfer facility, resource recovery facility, or disposal site shall accept,treat, store, or dispose of a hazardous waste at the facility, area, or site, unless the owner or operator holds a hazardous waste facilities permit or other grant of authorization from the department to use and operate the facility, area, or site, or the owner or operator is operating under a permit-by-rule pursuant to the department's regulations, or a grant of conditional authorization or conditional exemption pursuant to this chapter. (b) Except as necessary to comply with Section 25159.18, any person planning to construct a new hazardous waste facility or a new hazardous waste management unit,which would manage RCRA hazardous waste, shall obtain a hazardous waste facilities permit or a permit amendment from the department prior to commencing construction. (c) A hazardous waste facilities permit is not required for a recycle-only household hazardous waste collection facility operated in accordance with subdivision (b)of Section 25218.8. (d) A hazardous waste facilities permit is not required for a facility that meets the requirements of Section 13263.2 of the Water Code. CORRECTIVE ACTION: Immediately cease accepting hazardous waste from off-site in violation of the California Health&Safety Code and Title 22 California Code of Regulations. Apply for a permit with the California Department of Toxics Substances Control to operate a TSDF. Provide a corrective action statement and supporting documentation to the EHD within 30 days.
