4.6-1g: Conduct Preconstruction Surveys <br />for Nesting Migratory Birds and Raptors. <br />The Project Area supports suitable nesting <br />habitat for a variety of special -status birds and <br />birds protected under the MBTA. To minimize <br />impacts to protected bird and active nests <br />during construction, the following measures <br />Action: <br />Conduct <br />preconstruction <br />bird surveys. <br />Timing: <br />Within 14 days <br />Project Biologist <br />San Joaquin County <br />SJCOG <br />Initials <br />Initials <br />are required: <br />prior to the start of <br />• Conduct a pre -construction nesting <br />construction during <br />raptor and bird survey of all suitable <br />nesting season. <br />Date <br />Date <br />habitat on the Project site within 14 <br />days of the commencement ground <br />disturbance (e.g., tree/vegetation <br />removal, mass grading) during the <br />nesting season (February 1— <br />August 31). Where accessible, <br />surveys shall also be conducted <br />within 100 feet of the Project site. <br />• If active nests are found, a no - <br />disturbance buffer around the nest <br />shall be established. Per the <br />SJMSCP, a 100 -foot buffer shall be <br />established and maintained during <br />the nesting season for white-tailed <br />kite, Cooper's hawk, loggerhead <br />shrike, yellow -billed magpie, and <br />other birds protected under the <br />M BTA. <br />• The buffer shall be maintained until <br />the fledglings are capable of flight <br />and become independent of the <br />nest, to be determined by a qualified <br />biologist. Once the young are <br />independent of the nest, no further <br />measures are necessary. <br />In addition to the above, the following <br />SJMSCP Incidental Take Minimization <br />Measure shall be implemented should a known <br />Swainson's hawk nest tree (i.e., trees that <br />Section 1.0 Introduction 11 August 2022 <br />
