FINDINGS FOR WILLIAMSON ACT CONTRACT CANCELLATION <br /> PA -2200070 <br /> Finding No . 1 - That the cancellation is consistent with the purposes of the Williamson Act ; <br /> This finding that the cancellation is consistent with the purposes of the Williamson Act can be <br /> made in the affirmative as described below in the subfindings . <br /> a . The cancellation is for land on which a Notice of Nonrenewal has been served pursuant to Section <br /> 51245 of the Government Code . <br /> • This subfinding can be made because the landowner has served a Notice of Nonrenewal <br /> pursuant to Section 51245 of the Government Code . On April 6 , 2023 , the property owner <br /> submitted Notice of Nonrenewal No . PA-2200069 for the 1 . 57-acre portion of AM 015-020 - <br /> 64 that will be impacted by the proposed road . <br /> b . The cancellation is not likely to result in the removal of adjacent lands from agricultural use . <br /> • This subfinding can be made because the proposed cancellation for the road ( 1 . 57 acres ) <br /> is sized for the proposed 26 - lot subdivision . There is no intention or plan to expand the <br /> cancellation request and the remainder of the parcel will continue to be planted with a <br /> vineyard . <br /> c . The cancellation is for an alternative use which is consistent with the applicable provisions of the <br /> County General Plan . <br /> • This subfinding can be made because the alternative use for the 1 . 57 acres that are <br /> proposed for removal from Williamson Act contact is a roadway . Roadways are permitted <br /> in any San Joaquin County General Plan designation . <br /> d . The cancellation will not result in discontiguous patterns of urban development . <br /> • This subfinding can be made because the cancellation and proposed urban use is <br /> consistent with the previously approved and built out adjacent projects to the east . The <br /> cancellation of 1 . 57 acres of the existing contract will not result in a discontiguous pattern <br /> of urban development as it is for a roadway only . <br /> e . There is no proximate non - contracted land which is both available and suitable for the use to which it <br /> is proposed the contracted land be put , or, development of the contracted land would provide more <br /> contiguous patterns of urban development than development of proximate non -contracted land . <br /> • This subfinding can be made because there are no other existing , proximate parcels that <br /> would provide a more logical location for the access road to the parcel subject to the <br /> proposed subdivision . The proposed project will provide a contiguous pattern of urban <br /> development. <br />
