JOINT USE AGREEMENT <br /> BETWEEN THE LAM31ERSVH LE SCHOOL DISTRICT AND H <br /> MOUNTAIN HOUSE COMMUNITY SERVICES DISTRICT <br /> This agreement hereafter called the Joint Use Agreement is by and between the <br /> Lammensville School District hereinafter referred to as the "DISTRICT' and the Mountain <br /> House Community Services District, San Joaquin County, State of California herein <br /> referred to as "CSD". <br /> WHEREAS the CSD was formed to provide a variety of municipal services including <br /> Parks and Recreation and, <br /> WHEREAS Chapter 6 of Division 12, Part 3 of the Education Code of the State of <br /> California empowers public school districts to cooperate with special districts to enter into <br /> agreements for the purposes of organizing, promoting and conducting programs for <br /> community recreation, establishes a system of playgrounds and recreation and acquire, <br /> construct and improve, maintain and operate recreational centers and, <br /> WHEREAS, the Mountain House Community Master Plan calls for coordination in the <br /> development and operation of neighborhood parks and K-8 school sites and, <br /> WHEREAS, it is the public's interest that the recreational and educational facilities of <br /> public agencies be put to the fullest possible use. <br /> NOW THEREFORE the DISTRICT and the CSD hereby mutually agree as follows: <br /> 1. Definitions <br /> Joint Use Area - Any real property not owned by the DISTRICT located within the CSD <br /> that serves to help meet the land requirements for school facilities as set forth in the <br /> Education Code and serves to me--t park standards as set forth in the Mountain House <br /> Co ..tr.�.7 t;;Ma_�er Plan. <br /> School Play Areas - Any outside turf, hard surface, court, play apparatus area owned by <br /> the DISTRICT intended for public play purposes when not needed for regularly or <br /> specially scheduled DISTRICT authorized activities or functions. <br /> School Facilities - Any building or equipment owned by the DISTRICT intended for use <br /> by the DISTRICT during regularly or specially scheduled DISTRICT authorized <br /> functions. The DISTRICT shall identify certain facilities such as multi-purpose buildings <br /> for which other users may be scheduled by the DISTRICT. <br /> Development - Any construction or improvements that make land available for public <br /> use. <br /> 1 <br />
