School Function Hours - Shall be from 1/2 hour before regularly or specially scheduled <br /> DISTRICT functions start to 1/2 hour after DISTRICT functions cease. <br /> 2. Title to Land and Improvements <br /> Title to Joint Use Areas shall be vested to the CSD, however the DISTRICT shall have <br /> full rights to use the Joint Use Area to help meet any land requirements established by the <br /> Education Code, and shall have full use of such land as set forth in this Joint Use <br /> Amreement. <br /> 3. DesignlDevelopment of Joint Use Areas <br /> The responsibility for conceptual design of Joint Use Areas shall be shakes': ernlally by the <br /> CSD and DISTRICT. It is intended that the Joint Use Areas shall be designed primarily to <br /> satisfy DISTRICT turfed field and related physical education requirements and to <br /> complement and/or complete school play areas/facilities on adjacent DISTRICT owned <br /> property, and any aspect of that design required by the Education Code shall prevail. <br /> Either party may initiate conceptual design of a Joint Use Area. The DISTRICT, shall <br /> provide assistance to the CSD for conceptual design services related to the joint use area. <br /> The expense of preparing the final design shall be the sole responsibility of the CSD, <br /> unless otherwise agreed upon by both parties. Final design of the Joint Use Area will <br /> require approval from both the DISTRICT and the CSD. If one party does not agree to <br /> the proposed design and the other parry wishes to proceed with the project, the following <br /> procedures shall apply. <br /> The governing Boards of the DISTRICT and the CSD shall each appoint a 2- <br /> member committee to resolve the dispute. The committee members shall be <br /> appointed within 30 days after either parry has indicated to the other party that it <br /> does not agree to the proposed design. These committee members shall meet <br /> within 60 days and attempt to resolve any issues regarding objections to the design <br /> of the mint use area. If wit)in 60 days the commirtee members cannot resolve the <br /> issues,r the governing boards of each parry shall declare an impasse. Each parry <br /> agrees to then utilize the American Arbitration Association (or such other <br /> equivalent organization as agreed to by both parties) as a third party who shall be <br /> empowered to resolve the issues. The decision of this third parry shall be binding <br /> on both the DISTRICT and the CSD. Any costs associated with this process shall <br /> be shared equally by the DISTRICT and the CSD. <br /> Development or construction of a final design approved by both the DISTRICT and the <br /> CSD of Joint Use Areas shall be sole responsibility of the CSD. The CSD may initiate <br /> construction of an approved final design only with the written consent of the DISTRICT. <br /> All development costs of a mutually approved final design of Joint Use Areas shall be the <br /> sole responsibility of the CSD, unless otherwise agreed upon by both parties. The neither <br /> party shall attempt to stop construction of mutually approved final designs in any way. <br /> 2 <br />
