• This finding can be made since County staff has concluded,based an assessment of <br /> the health-related concerns covered in the Mountain House Neighborhood"F"Project <br /> Initial Study and Mitigated Negative Declaration,SCH#90020776, that the design of the <br /> subdivision,as conditioned,would either have no impact or less than significant impact <br /> on the health of future residents.Refer also to the Supplemental Findings attached to <br /> the staff report. <br /> 7. The design of the subdivision or the type of improvements will not conflictwith easements <br /> acquired by the public at large for access through or use of property within the proposed <br /> subdivision. <br /> • This finding can be made since there are no permanent access easements that have <br /> been acquired by the public at large within the subdivision. Public easements that will <br /> be needed to provide access to public facilities within the subdivision are incorporated <br /> into the design of the proposed subdivision. (Note:A temporary access easement or <br /> lease will be acquired by the CSD from Trimark for the interim sports park located to the <br /> north of the proposed subdivision. Once the facilities are no longer needed,when the <br /> permanent sports park is constructed,the easementwill be quitclaimed back to Trimark, <br /> or the lease terminated.)Refer also to the Supplemental Findings attached to the staff <br /> report. <br /> 8. Any land or improvementto be dedicated to a public agency is consistentwith the General <br /> Plan,the Master Plan,any applicable Specific Plan, any applicable Special Purpose Plan, <br /> and any other applicable plan adopted by the County. <br /> • This finding can be made since the lands or improvements to be dedicated to the CSD <br /> or the Lammersville School District(i.e., roads,entries, K-8 school site; sanitary sewer, <br /> public water, public storm drainage facilities;bike paths, pedestrian paths,multi-use <br /> path)are consistentwith the Public Land Equity Program and/or required to meet CSD <br /> Design and Construction Standards, both of which are implementation measures for the <br /> General Plan, Master Plan, Specific Plan I, and the Special Purpose Plan for <br /> Neighborhood"F." <br /> 9. The design of the subdivision provides,to the extent feasible,for future passive or natural <br /> heating or cooling opportunities in the subdivision,as required by Government Code <br /> 66473.1. <br /> • This finding can be made because the proposed subdivision has been laid out in a <br /> modified grid pattern,allowing most homes to face due north,south,east,or west,and <br /> because of the requirement for street trees. Since the street trees would be deciduous, <br /> in cooler seasons sun exposure to each home would be maximized to relieve natural <br /> gas demands for heating,while in warmer seasons tree foliage would provide shade <br /> relief thereby reducing electricity needs for air conditioning.Although passive solar <br /> design within the proposed subdivision is constrained because of Master Plan and <br /> Specific Plan I residential density requirements and the low angle of winter sunlight <br /> when passive heating is most needed,the lot orientation and street design coupled with <br /> the requirementfor, and characteristics of, street trees maximizes to the extent feasible <br /> the passive or natural heating or cooling opportunities within the proposed subdivision. <br /> Refer also to the Supplemental Findings attached to the staff report <br /> 10. All applicable provisions of the Mountain House Development Agreement have been met <br /> This finding can be made since the consistency analysis that has been conducted has found <br /> that the proposed subdivision is consistentwith the provisions of the Mountain House <br /> -29- <br />
