lawsuits were filed challenging the MEIR on other grounds. However, each lawsuit was <br /> dismissed after a full trial on the merits. The MEIR provides evidence that the site is <br /> physically suitable for the proposed development. The County finds that it is reasonable <br /> to rely upon conclusions of the certified EIR. In addition, the County Planning <br /> Department staff independently reviewed the physical suitability of the site for the Map <br /> and concluded that the site was physically suitable. In reaching this conclusion the <br /> County also reviewed the various engineering, hydrology and soil suitability studies that <br /> have been prepared and reviewed for this project. <br /> THE DESIGN OF THE MAP OR TYPE OF IMPROVEMENTS ARE NOT <br /> LIKELY TO CAUSE SUBSTANTIAL ENVIRONMENTAL DAMAGE OR <br /> SUBSTANTIALLY AND AVOIDABLY INJURE FISH OR WILDLIFE OR <br /> THEIR HABITAT. <br /> 5. The County finds that the design of the Map or the type of improvements is not likely <br /> to cause substantial environmental damage or substantially and avoidably injury fish or <br /> wildlife or their habitat. The County incorporates by this reference as though set out in <br /> full the FINDINGS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL <br /> QUALITY ACT FOR ADOPTION OF THE MITIGATED NEGATIVE <br /> DECLARATION (CEQA Findings), as approved for the Neighborhood F Project. The <br /> County also incorporates by this reference as though set out in full the 1999 Expanded <br /> Initial Study and Mitigated Negative Declaration (SCH 98032027)prepared for the use <br /> permit for the wastewater facility. <br /> THE DESIGN OF THE MAP OR TYPE OF IMPROVEMENTS ARE NOT <br /> LIKELY TO CAUSE SUBSTANTIAL ENVIRONMENTAL DAMAGE OR <br /> SUBSTANTIALLY AND AVOIDABLY INJURE FISH OR WILDLIFE OR <br /> THEIR HABITAT. <br /> 6. The County finds that the Map or the type of improvements is not likely to cause <br /> serious public health problems. In making this finding, the County observes that the <br /> design of the Map and the types of improvements were subject to environmental review <br /> under the California Environmental Quality Act. The Initial Study concluded that the <br /> Map would not cause serious public health problems. In addition, the Local Health <br /> Department reviewed the Map and concluded that, in their independent opinion, the Map <br /> would not result in a serious public health problem. <br /> THE DESIGN OF THE MAP OR THE TYPE OF IMPROVEMENTS WILL NOT <br /> CONFLICT WITH EASEMENTS, ACQUIRED BY THE PUBLIC AT LARGE, <br /> FOR ACCESS THROUGH OR USE OF, PROPERTY WITHIN THE MAP. <br /> 7. The County finds that the design of the Map or the type of improvements will not <br /> conflict with the easements, acquired by the public at large, for access through or use of, <br /> 3 <br />
