In making this finding, the County observes that the County <br /> Public Works Department reviewed the Map against any possible public easement. <br /> According to the County Public Works department, the Map would not conflict with such <br /> easements. In fact, the Map offers public easements that are needed and useful to provide <br /> public services to land within the Map. <br /> THE DESIGN OF THE MAP PROVIDES, TO THE EXTENT FEASIBLE, <br /> FUTURE PASSIVE OR NATURAL HEATING OR COOLING <br /> OPPORTUNITIES. <br /> 8. The County finds that the design of the Map provides, to the extent feasible, future <br /> passive or natural heating or cooling opportunities. The County Planning Department <br /> reviewed the Map's design against passive or natural heating or cooling opportunities. <br /> According the County Planning Department, the Map provides, to the extent feasible, <br /> future passive or natural heating or cooling opportunities. Section IIIA. of the Development Agreement requires the County to make additional <br /> determination before approving a subsequent discretionary approval. The County finds <br /> that all these determinations can be made. <br /> 9.A. The County determines that the Map is within Mountain House Specific <br /> Plan Area I. <br /> 9.13. The County determines that the Mountain House Community Service <br /> District has been formed and that (a) the County and CSD have executed a Public <br /> Services Allocation agreement which includes development of the real property subject <br /> to the Map; and (b) Trimark Communities and the CSD have executed an agreement <br /> providing for infrastructure and urban services to be provided in connection with the <br /> proposed development of the real property. <br /> 9.C. The real property subject to the Map is subject to the Development <br /> Agreement. <br /> 9.D. As found at Finding 2, the Map is consistent with the policies, goals, <br /> standards and requirements of the Existing Approvals (as the term is defined in the <br /> Development Agreement) and the Development Agreement. <br /> 4 <br />
