Approve Text Amendment No. TA-01-02 by adopting the attached Ordinance, <br /> which includes by reference the amended Specific Plan Reimbursement Program <br /> Technical Report, based on the "Reason for Recommendation" contained in this <br /> Board Letter; <br /> 2. Adopt the attached amended Resolution for Specific Plan Reimbursement Fees <br /> that provides an administrative fee component for specific plan reimbursement <br /> fees and updates said fees to include other charges incurred by Trimark <br /> Communities, Inc.; and <br /> 3. Make the finding for exempting the proposed administrative fee from CEQA as <br /> set forth in this Board Letter. <br /> BACKGROUND: <br /> Ori August 10, 1999,the Board of Supervisors adopted Ordinance No. 4033 and Resolution No. <br /> 9=99-472, authorizing and establishing specific plan reimbursement fees to reimburse Trimark <br /> Communities("Trimark") and other developers for the cost of preparing and adopting specific <br /> plans. Under the Ordinance, the Mountain House Master Plan is regarded as a master specific <br /> plan, and, therefore, is eligible to be included as a reimbursable expense. Under the Resolution, <br /> Trimark is to receive 100% of all revenues, including interest, generated by the Mountain House <br /> Master Specific Plan Reimbursement Fee and the Mountain House Specific Plan I <br /> Reimbursement Fee(collectively referred to as the"Specific Plan Reimbursement Fees"). <br /> The previously adopted Specific Plan Reimbursement Fees are based on costs incurred by <br /> Trimark, from February 1993, through July 1999, for activities that both the County and Trimark <br /> agreed were eligible reimbursable expenses under the County's Cost Reimbursement Program <br />
