1 the neighboring property to the south (the property to the south located at 23201 South Santa F <br /> 2 Road, also referred to as the Lane Property). <br /> 3 10. The observed waste on April 22, 1998 violates disposal and storage regulations under the <br /> 4 Public Resources Code, Health and Safety Code, California Code of Regulations, and San <br /> 5 Joaquin County Ordinance. Specifically for disposal site standards, violations were committed <br /> 6 under Public Resources Code, Part 4, Chapter 1, Sections 43000 — 43022; California Health <br /> 7 Safety Code, Section 25189.5 (Hazardous Waste); California Code of Regulations, Article 7.8 <br /> 8 Sections 17760 — 17796; and San Joaquin County Ordinance No. 2887, Sections 5-2400 — 5- <br /> 9 2600. Illegal storage violations were committed according to the Health and Safety Code <br /> 10 Sections 25201 (a) (Hazardous Wastes); California Code of Regulations, Article 5, Section <br /> 11 17301 — 17345, & Article 5.5 (waste tire storage and disposal), Sections 17350— 17356; and San <br /> 12 Joaquin County Ordinance No. 2887, Section 5-2400 & 5-2403; and any and all additional <br /> 13 Federal, State and Local regulations that might apply to disposal and clean-up of said illegal <br /> 14 disposal and storage of waste on this site. As a result of the findings of this inspection, the <br /> 15 department contacted members of the State of California Integrated Waste Management Board. <br /> 16 11. On June 2, 1998, Steve Mindt an employee of the Environmental Health Division <br /> 17 conducted an inspection of the property. Pictures were taken from the roadway by Steve Mindt <br /> 18 (See Exhibit A, incorporated herein by reference). The pictures show that solid waste had been <br /> 19 recently dumped on the property. The pictures show piles of organic waste(trees and bushes) <br /> 20 from landscaping , waste tires, and household solid waste that was accumulated on the property. <br /> 21 12. On June 3, 1998, Steve Mindt an employee of the Environmental Health Division <br /> 22 continued the inspection and investigation of the property with Tom Sweeso, a Cod <br /> 23 Enforcement Officer with the San Joaquin County Community Development Department, who <br /> 24 had previously been on that site, and employees of the California Integrated Waste Management <br /> 25 Board, Brad Williams and Jerry Oberhelman. The site was viewed from South Santa Fe Road <br /> 26 and from the Lane Property, and pictures were taken of wastes on site (See Exhibit B <br /> 27 incorporated herein by reference).
