The east side has a wide road right of way and is upstream of the prevailing
underwater flow.
Because of this layout, it is not possible for our property to do any new
contamination from the property being used as a landfill 20 to 70 years ago.
10. We purchased the property for$8,800 and have spent $1,200.00 for part of the
property's surface cleanup. If there are any plans by any government agencies
to run up bills and/or deny us the use of our property, we recommend that they
reimburse us for our costs and withdraw San Joaquin County's sale of the
property. They were not able to supply the title and use of the property. The
county can then run and control the property as they wish.
11. On May 25th, 2 hours after the auction, we went to the Health Dept. to find
what they had on the property regarding the statement of "possible
contamination". Mike Huggins said that we bought a nightmare. They told us
to request the files on this property, and they would review it with us.
On June 16, 22 days later, they assembled the file and had us meet with Robert
Mc Clellon o0the Health Department. He said he had already made up the
letters of a 30 day notice demanding the new buyers to begin the$200,000
property cleanup within 30 days.
The holdup was waiting for a set of buyers and their addresses to put on the
notice. He also said that he would start attaching all of the buyers' other
properties because of the purchase of this 10 acres, to insure a cleanup.
(Statements made by Robert Mc Clellon June 16, 2000)
Items to be done(as reviewed by Robert McClellon, June 16, 2000):
A. Dig up 30,000 yds. of landfill and take to another landfill.
B. Take all the pieces of concrete and grind them up to spread on the
land and wait for the rain on this concrete powder.
C. Leave a large trench on the back of the property. Of course this
would weaken the Amtrack and Santa Fe railroad bed and tracks 30
feet above our property and weaken the levee containing the sewer
ponds.
D. Financially drain the buyers, just as he was Cal-State Mortgage on
their 16 acres next door, because that property had been put into
their name by foreclosure!
