9 0 <br /> Funding would like to meet with the EHD prior to any further action being <br /> taken. The letter explained that they would like to see if a resolution could be <br /> met. <br /> 06/08/00—Meeting with Sherri M. Kirk of the Kirk Law Finn and Peter Bednarek <br /> representing Delta Funding LTD PTP; Dee Anne Watkins of County Counsel; <br /> Mike Huggins and Robert McClellon of the EHD. The site status was <br /> discussed. Sherri M. Kirk argued that lender liability exclusion would apply <br /> and that Delta Funding would not be responsible for any cleanup. Dee Anne <br /> Watkins did not agree with that assertion. Peter Bednarek stated that they <br /> foreclosed on the property and would like to get out from under it. Peter <br /> Bednarek and Sherri Kirk were concerned that the Notice and Order would <br /> not allow them to sell the property. Dee Anne Watkins indicated that the <br /> property could be sold. Dee Anne Watkins also indicated that Delta Funding <br /> or the new owners could satisfy the requirements of the Notice and Order. <br /> The meeting ended with Delta Funding agreeing to remove surface debris, <br /> have the site secured, have the site surveyed, and based on the outcome of the <br /> survey, conduct an investigation on the subsurface burial of solid waste. <br /> 06/12/00—The EHD received a letter from the Kirk Law Firm. The letter confirmed the <br /> agreements that were made during the meeting of June 08, 2000. The letter <br /> stated that Delta Funding would submit a proposal for securing the property <br /> and determining the southern property boundary. The letter also confirmed <br /> the agreement to investigate the mound that had been subject to subsurface <br /> burial. <br /> 07/14/00—The EHD received a letter from Peter Bednarek of Delta Funding indicating <br /> that they were going to have the property surveyed and have the site secured <br /> by trenching access areas. Robert McClellon phoned Peter Bednarek and <br /> explained that the physical barriers should not create a situation where a <br /> passerby may become trapped or become injured. He agreed. <br /> 08/24/00—On or about this date the EHD received a phone call from Lieutenant Gerald <br /> Rector of the San Joaquin County Sheriffs Office. Lt. Rector inquired as to <br /> the site status. He was informed that the site was under a Notice and Order by <br /> this Department and that the owners need to comply. He explained that he <br /> would like to help to get the issues resolved. He offered to be a mediator <br /> between the property owners and this Department. He was informed that if the <br /> owners complied with the Notice and Order that the issued would be resolved. <br /> Robert McClellon referred him to Dee Anne Watkins of County Counsel's <br /> Office. <br /> 08/28/00—Meeting with Peter Bednarek of Delta Funding, Mike Huggins, Steven Shih, <br /> and Robert McClellon of EHD at the site. Peter Bednarek brought a <br /> prospective buyer with him to the meeting. Peter Bednarek was irritable and <br /> made comments that the EHD was making something out of nothing.
