suggested that the EHD should just drop the issue. The buyer was willing to <br /> do some work to resolve the issues that the EHD had at the site and explained <br /> that he was familiar with environmental cleanups. It was explained to him <br /> what he would have to do in order to remove the Notice and Order and that <br /> this Department was willing to provide assistance and oversight to help <br /> resolve the issues. It was suggested that he stop by the Department and review <br /> the file and that it would be made available to him. <br /> 09/08/00—Meeting with Peter Bednarek of Delta Funding, Mike Huggins, Alan <br /> Beidermann and Robert McClellon of the EHD. Peter Bednarek brought <br /> another prospective buyer to the meeting. The site status was discussed with <br /> the prospective buyer and the EHD again offered to help by reviewing plans <br /> and providing oversight for the cleanup efforts. The new buyer was provided <br /> with contact information for this Department. <br /> 09/08/00—Robert McClellon of the EHD phoned Dee Anne Watkins of County <br /> Counsel's Office. He explained to her that Delta Funding had not complied <br /> with the Notice and Order and asked for direction with regard to further <br /> enforcement. Dee Anne indicated that the EHD could refer the issue to the <br /> District Attorney for prosecution. Robert McClellon informed Mike Huggins <br /> that he was going to refer the matter to the District Attorney's Office. Mike <br /> Huggins agreed. <br /> 09/11/00—The file was referred to the District Attorney's Office this date. <br /> 09/25/00—Meeting with Gerald Rector and Don Mann of the San Joaquin County <br /> Sheriffs Office. Mike Huggins, Alan Biedermann, and Robert McClellon <br /> were present from the EHD. David Irey was also present for the San Joaquin <br /> County District Attorney's Office. The meeting was held at the site. Gerald <br /> Rector and Don Mann were trying to resolve the issues at the site. Robert <br /> McClellon explained that the property owners are under an Administrative <br /> Enforcement Order to clean up and secure the property and investigate the <br /> area that was suspected of having subsurface disposal. He also explained that <br /> the EHD referred the issue to the District Attorney's Office. David Irey <br /> explained that he would need to meet with the owners prior to him making <br /> any type of settlement. During the site visit it was noted that there had been <br /> some excavation on the property. There was a trench that started at the north <br /> end of the property and followed the east property line south to the south <br /> property line. The trench then turned west along the south property line and <br /> stopped just short of the west property line. The trench went through a pile of <br /> burned tires and ash. <br /> 03/08/01 —Onsite visit with District Attorney David Irey, Mike Huggins, Robert <br /> McClellon, Attorney Sherri Kirk of the Kirk Law Firm representing Delta <br /> Funding. Jack Meranda of Prudential California Realty was also present. Jack <br /> Merenda was representing a potential buyer. Mr. Merenda was asking <br /> Page 4 of 5 <br />
