1 FINAL JUDGMENT <br /> 2 Based upon the STIPULATION between the parties hereto, through their respective <br /> 3 counsel of record, and good cause appearing therefor, <br /> 4 IT IS HEREBY ORDERED,ADJUDGED,AND DECREED: <br /> 5 1. This court has jurisdiction of the subject matter of this action and each party <br /> 6 hereto; <br /> 7 2. The injunctive provisions of this Stipulated Judgment are applicable to <br /> 8 plaintiff, its members, officers, employees, agents, and representatives, to all persons acting by, <br /> 9 through, under, or on behalf of plaintiff, and to all persons acting in concert with or participating <br /> 10 with plaintiff with actual or constructive knowledge of this Permanent Injunction; <br /> 11 3. Plaintiff, its members, officers, agents, employees, representatives, and all <br /> 12 persons acting in concert or participating with it are hereby permanently restrained and enjoined <br /> 13 from violating Title 14, California Code of Regulations, section 17331 (Frequency of Refuse <br /> 14 Removal) and San Joaquin County Ordinance, Code No. 5x2400 (Accumulation of Refuse, Waste <br /> 15 and Filth Prohibited), in connection with its ownership of that certain real property described as <br /> 16 23023 S. Santa Fe Road,Riverbank,California, APN#249-060-13 ("the Property"); <br /> 17 4. Plaintiff shall comply with all applicable land use restrictions with respect to <br /> 18 the Property including, but not limited to, Title 27, California Code of Regulations, Section <br /> 19 21190(c); <br /> 20 5. Plaintiff shall comply with Title 27 California Code of Regulations, section <br /> 21 20530 and will secure the site in a manner reasonably designed to discourage unauthorized access to <br /> 22 the property; <br /> 23 6. Plaintiff shall comply with Title 27 California Code of Regulations, section <br /> 24 20830 and remove all surface debris and maintain the site free of litter and garbage; <br /> 25 7. Plaintiff shall implement a preventative maintenance program to monitor and <br /> 26 repair any hazardous conditions, including, but not limited to, conditions caused by rainfall or other <br /> 27 weather conditions, and to monitor and maintain the integrity of any fencing or other barrier <br /> 28 designed to discourage unauthorized access to the Property.
