Plaintiff shall allow both the County, as well as the California Integrated Waste 3 Management Board ("CIWMB"), including its employees, agents, contractors, and subcontractors, 4 reasonable access to the Property for purposes of conducting any remediation of the Property, 5 including but not limited to any remediation conducted under the CIWIVIB's Solid Waste Disposal 6 and Codisposal Site Cleanup Program(Pub.Res. Code §§ 48020-48028); 7 9. Notice and Order No. 00-01, issued to Plaintiff on or about April 10, 2000, 8 pursuant to California Public Resources Code sections 45000, 45005, and 45011, shall be held in 9 abeyance and subject to this Stipulation and Final Judgment; 10 10. Plaintiff shall make all disclosures required by law regarding the Property to 11 any and all prospective purchaserstbuyers of the Property, including,but not limited to disclosure of 12 this Stipulation and Final Judgment; 13 11. Nothing contained in this Stipulated Final Judgment shall relieve any 14 subsequent or successor owner of the Property of any liability or obligation that it may have under 15 the California Integrated Waste Management Act (Division 30 of the Public Resources Code), 16 including all applicable provisions of Public Resources Code sections 48020 through 48028; 17 12. This Stipulation and Final Judgment herein shall be binding only upon Delta 18 Funding and is not applicable to any futurepurchaser/buyer of the Property; 19 13. This Stipulated Final Judgment, including the Permanent Injunction, shall be 20 effective and enforceable immediately upon entry by this Court. Entry of this Stipulated Final 21 Judgment is authorized immediately upon filing of same; and 22 14.
