Agricultural Technical Advisory Committee shall be permitted pursuant to <br /> Subsection (d) (2 ) so long as the land purchased by the Mitigation Bank meets the <br /> requirements of Sections 94080 . 3 (c) and 94080 . 5 subject to the following <br /> provisions : <br /> (th) Final Approvals . Final appfeval of afty o project subject to Subsection (a) of <br /> this Section shall be approved by the County without a requirement to executer, <br /> of the legal instrument to provide agricultural mitigation land and payment of the <br /> administrative fee , or participation in an approved mitigation bank , or approval <br /> and payment of an in- lieu fee . Submission of the required legal instrument or <br /> payment of the in- lieu fee sha44is required to occur at the time of Grading Permit <br /> or Building Permit issuance . <br /> (gi) Participation . Agricultural <br /> mitigation land shall include the Delta . The type of agricultural related activity <br /> allowed on mitigation land will be limited to activities allowed in the land ' s <br /> agricultural zone as specified in an agricultural easement or related legal <br /> instrument, as described in Section 9 - 1080 . 7 . <br /> (b) Soil Quality .
