Mrs. Joann Krein
October 12, 1978
Page Two
11
2. You have indicated that Forward, Inc. is hauling debris
from Stanislaus County, namely Modesto, California.
This is not a violation of the Forward, Inc. Use
Permit. Refuse may be hauled in from outside the
'County.
3. You have made reference to the anti -littering law.
We have been advised by the California Highway
Patrol that due to the fact that many different
vehicles utilize Austin Road to haul refuse, it
would be very difficult to prove that Forward, Inc.
was the sole responsible party. It is the Highway
Patrol's recommendation that if you witness a
violation of the anti -littering law, note the
vehicle's license number, the date and the time,
and report it to the Highway Patrol (phone: 931-1431).
4. You state that Forward, Inc. has used a tractor to
ruin your road and that the marks are still there.
We discussed this with the representative from
Forward, Inc. and he advises us that there would
be no reason for Forward, Inc. to run one of their
tractors outside of the landfill site.
Again, we suggest that if you see someone driving
a tractor on the road, try to obtain some type
of identification or detailed description and note
the date and the time and report it to the Highway
Patrol.
5. You have made reference to two Ordinances; 1460A
Streets & Highway and Public Nuisance No. 370.
Section 1460(a) of the California Streets & High-
ways Code reads: The road commissioner may issue
written permits, as provided in this chapter,
authorizing the permittee to do any of the follow-
ing acts:
(a) Make an opening or excavation for any purpose
in any county highway.
