You have indicated that Forward, Inc. is hauling debris <br />from Stanislaus County, namely Modesto, California. <br />This is not a violation of the Forward, Inc. Use <br />Permit. Refuse may be hauled in from outside the <br />'County. <br />3. You have made reference to the anti -littering law. <br />We have been advised by the California Highway <br />Patrol that due to the fact that many different <br />vehicles utilize Austin Road to haul refuse, it <br />would be very difficult to prove that Forward, Inc. <br />was the sole responsible party. It is the Highway <br />Patrol's recommendation that if you witness a <br />violation of the anti -littering law, note the <br />vehicle's license number, the date and the time, <br />and report it to the Highway Patrol (phone: 931-1431). <br />4. You state that Forward, Inc. has used a tractor to <br />ruin your road and that the marks are still there. <br />We discussed this with the representative from <br />Forward, Inc. and he advises us that there would <br />be no reason for Forward, Inc. to run one of their <br />tractors outside of the landfill site. <br />Again, we suggest that if you see someone driving <br />a tractor on the road, try to obtain some type <br />of identification or detailed description and note <br />the date and the time and report it to the Highway <br />Patrol. <br />5. You have made reference to two Ordinances; 1460A <br />Streets & Highway and Public Nuisance No. 370. <br />Section 1460(a) of the California Streets & High- <br />ways Code reads: The road commissioner may issue <br />written permits, as provided in this chapter, <br />authorizing the permittee to do any of the follow- <br />ing acts: <br />(a) Make an opening or excavation for any purpose <br />in any county highway. <br />
