Manteca Police Department <br /> Policy Manual <br /> Temporary Holding Facility <br /> 900.6.6 FIRST-AID/PROFESSIONAL MEDICAL ATTENTION <br /> As necessary, evacuating personnel will apply first-aid techniques to those prisoners injured <br /> as a result of the emergency or injured during the evacuation procedure until professional <br /> medical aid arrives to assist. <br /> 900.6.7 REPORTS <br /> The Watch Commander will ensure that any emergency evacuation of the Temporary <br /> Holding Facility is documented and that copies of those reports be forwarded to the <br /> Temporary Holding Facility Manager and Temporary Holding Facility Administrator. <br /> 900.7 PRISONER TELEPHONE CALLS <br /> Every prisoner,whether adult or juvenile, detained in the Temporary Holding Facility shall be <br /> entitled to at least three completed telephone calls immediately upon being booked and no <br /> later than three hours after arrest. If it is determined that the person is a custodial parent with <br /> responsibility for a minor child, the person shall be entitled to make two additional telephone <br /> calls for the purpose of arranging care for the minor child (Penal Code § 851.5). <br /> There is no obligation for the officer to make a call on a prisoner's behalf-for example in <br /> the case of a person that is so intoxicated that he or she cannot make a call. An officer <br /> is not required to wake an intoxicated person three hours after booking so that they may <br /> complete a call. <br /> There is also no limitation on the amount of time a prisoner's phone call must last. A prisoner <br /> should be given sufficient time on the phone to contact whomever he/she desires and to <br /> arrange for necessary items because of his/her arrest. The phone calls are not intended <br /> to be lengthy conversations and the officer may use his or judgment in determining the <br /> duration of the calls. <br /> 900.7.1 TELEPHONE CALL PROCEDURES <br /> The Department will pay the cost of local calls. Long distance calls must be paid by the <br /> prisoners using calling cards or by calling collect. <br /> Calls between the prisoner and his/her attorney shall be deemed confidential and shall not <br /> be monitored, eavesdropped upon or recorded. <br /> The provisions of Penal Code § 851.5 shall be posted in bold block type in a conspicuous <br /> place within the Temporary Holding Facility. <br /> 900.7.2 ON-GOING TELEPHONE ACCESS <br /> Once a prisoner has completed telephone calls provided by Penal Code § 851.5 and it <br /> appears that the individual is not going to be released or transferred to another custodial <br /> facility, reasonable efforts should be made to provide the prisoner with access to a <br /> telephone, as practical. In providing further access to a telephone beyond that required <br /> by Penal Code § 851.5, legitimate law enforcement interests such as officer safety, effect <br /> on ongoing criminal investigations and logistics should be balanced against the prisoner's <br /> desire for further phone access. <br /> 900.8 HANDLING OF PRISONER'S PROPERTY <br /> Officers shall take care in the handling of a prisoner's property to avoid discrepancies or <br /> losses. <br /> Temporary Holding Facility-416 <br /> Adopted: 2012/04/01 ©1995-2012 Lexipol,LLC <br />
