The following is an itemized list of hazardous materials violations that have not been <br /> addressed for UNLIMITED COMPANY INC DBA : SMIT FARMS as of September <br /> 09 , 2022 . <br /> Open violations from August 10, 2021 inspection <br /> Violation #16 - Failed to electronically submit ER plan when not meeting Ag handler exemption <br /> requirements . <br /> OBSERVATION This farm business does not meet the requirements for exemption from filing emergency response <br /> ( ER) procedures in the California Environmental Reporting System (CERS) . The farming business did not: <br /> - annually submit the Hazardous Materials Inventory <br /> - mark each building that stores any pesticides , petroleum fuels and oil , or fertilizers with warning signs <br /> - provide training for all employees in safety procedures in the event of a release or threatened release of a <br /> hazardous material . <br /> REGULATION GUIDANCE: To meet this exemption , a farming business shall: <br /> - annually submit the Hazardous Materials Inventory <br /> - mark each building that stores any pesticides , petroleum fuels and oil , or fertilizers with warning signs <br /> - provide training for all employees in safety procedures in the event of a release or threatened release of a <br /> hazardous material . <br /> CORRECTIVE ACTION(S ) : Immediately take all steps to meet the requirements for exemption from filing <br /> emergency response procedures , or log into the CERS at http : //cers. calepa . ca . gov/, and upload emergency <br /> response procedures for a release or threatened release of hazardous materials , including , but not limited to , the <br /> following : <br /> - immediate notification of local emergency personnel and the Environmental Health Department ( EHD ) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons , property , or the environment <br /> - evacuation plans and procedures , including immediate notice , for the site . <br /> ❑ This violation was corrected ❑ This violation will be corrected by ( date) . <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation : <br /> Page 4 of 5 <br />
