Hirata, Director of Public Works <br /> SUBJECT: FORWARD, INC. - AUSTIN ROAD SOLID WASTE FACILITY <br /> Pursuant to your memorandum of December 20, 1982, the Department of Public <br /> Works reviewed its files and conducted a field review of the above referenced <br /> facility to determine whether said facility is operating in substantial compliance <br /> with Use Permit No. U-73-9, issued by San Joaquin County on February 15, 1973. <br /> The Public Works field review was conducted principally to determine compliance <br /> with construction and maintenance aspects of the Use Permit and the Plot Plan <br /> filed pursuant to Use Permit condition #3. <br /> The landfill operation appeared physically adequate with no serious deviation <br /> from the topographic Plot Plan. No appreciable standing water was present, and <br /> flood control and drainage requirements are being met. <br /> However, fencing, landscaping, and road paving indicated on the Plot Plan <br /> have not been accomplished to date. According to our departmental records, <br /> failure to comply with these conditions has been brought to the attention of <br /> Forward, Inc. on previous occasions. <br /> The Resource Recovery operation, contemplated in the Use Permit and indicated <br /> in the Plot Plan, does not appear to be operating. The Resource Recovery building <br /> is in very poor condition; piles of construction debris dot an unkempt facility. <br /> This situation constitutes a physical nuisance in violation of the general <br /> condition of the Use Permit that the facility not develop into a nuisance. No <br /> signs are posted to direct public and vehicular traffic to the recovery station <br /> as required by Use Permit special condition #4. There was no one present at the <br /> site to operate the Recovery Station. <br />
