Dermody -2- February 7, 1983 <br /> As you know, the State Department of Health conducted a field review of <br /> this facility on December 2, 1982, to determine compliance with the Hazardous <br /> Waste Facility Permit. In a letter dated December 13, 1982, the State <br /> Department of Health notified Forward, Inc. of a number of violations of that <br /> permit. Inasmuch as the Use Permit requires the facility to operate in com- <br /> pliance with state and local laws and regulations, the Department of Public <br /> Works made the following observations regarding the violations mentioned in <br /> that December 13, 1982 letter: <br /> 1. As previously noted, there are no secure barriers (fencing) <br /> around the perimeter of the site to prevent entry <br /> 2. There is only one warning sign posted where entering the <br /> Class II-1 area, but none posted around the site perimeter <br /> 3. The hazardous waste is not being covered daily as required in <br /> that the equipment used for daily cover appears non-operational <br /> 4. There did not appear to be any discolored leachates or <br /> mismanagement of hazardous wastes; the trenches and ponds <br /> appeared in good condition; flood control and drainage was <br /> adequate. <br /> It is noted that, in its December 13, 1982,letter to Forward, Inc. , the <br /> State Department of Health required the facility to submit a Plan of Correction <br /> regarding the hazardous waste violations by December 31 , 1982. No such plan <br /> has been submitted to date. <br /> Based upon the field review, state and local reports of violations, and a <br /> review of our records, the Department of Public Works is of the opinion that <br /> the Forward, Inc. Austin Road Solid Waste Facility is not in substantial com- <br /> pliance with the conditions of the Use Permit. <br /> The Department of Public Works will be glad to assist Forward, Inc. and <br /> state and local agencies to work out a program to bring the facility into <br /> compliance with its use and operational permits. <br /> HMH:TM:jg <br /> cc: illiam Cypher, Public Works <br /> Lee Hall, Public Health <br /> Harry Riddle, Building & Planning <br />
