1.5. Exhibits. All exhibits attached to this Order are <br />incorporated herein by this reference. <br />1.6. Applicable Statutes and Regulations. Copies of the <br />statutes and regulations applicable to this Order are attached <br />as Exhibit 2. <br />DETERMINATION OF VIOLATIONS <br />2. The Department has determined: <br />2.1. The Respondent violated Title 22, California Code of <br />Regulations (CCR), sections 66264.16 (d) (4) and 66264.16 (e) in <br />that on or about October 24, 1991 Respondent did not: have <br />records showing that annual training had been give to employees <br />prior to 1990. <br />2.2. The Respondent violated Title 22, California Code of <br />Regulations (CCR), section 66264.71 (a) (6) in that on or about <br />October 24, 1991 and September 3, 1992, Respondent did not: <br />maintain copies of manifests for wastes received at the facility. <br />After receipt of wastes, manifests are sent to the Respondents <br />business office located in downtown Stockton. <br />2.3. The Respondent violated Title 22, California Code of <br />Regulations (CCR), section 66264.90 and section 66270.30 in that <br />on or about October 21, 1991 Respondent did not: follow the <br />written and approved Sampling and Analysis Plan (SAP) for <br />Groundwater which is incorporated as Attachment 1 of the RCRA <br />Post -Closure permit dated June 3, 1991 and Appendix B of the <br />Hazardous Waste Facility Post Closure Permit issued January 2, <br />2. <br />
