Your request is based on the 10 June 1993 letter issued by <br />the Department of Toxic Substances Control which approved this material to be classified and <br />managed as nonhazardous waste. We note the DTSC approval specifically states that the material <br />may be managed as nonhazardous provided it is discharged to a Class H landfill constructed at the <br />Port of Oakland. Discharge of this soil at Forward would not be consistent with the conditions of <br />the DTSC classification.
