2 . Solid Waste Facilities Permit No. 39-AA-015 (11SWFP11) . <br /> The SWFP, issued in 1978, identifies the Landfill as a Class II- <br /> 1 facility. It allows the Landfill to accept residential refuse, <br /> commercial solid wastes, tires, industrial wastes, construction <br /> demolition wastes, sewage sludge, liquids/slurries, limited <br /> hazardous wastes (as approved by the Regional Board) , and septic <br /> tank pumpings. The SWFP was issued under the jurisdiction of the <br /> California Waste Management Board (11CWMB11) . The San Joaquin County <br /> Public Health Services, Environmental Health Division (11PHS11) is <br /> the local enforcement agency. <br /> The California Integrated Waste Management Board (11CIWMB11) , <br /> successor to the CWMB, has taken the position that, in the absence <br /> of revision of the SWFP or interim relief from PHS, the SWFP allows <br /> Forward to accept only 700 cubic yards of waste per day. (Forward <br /> has taken the position that the SWFP allows it to accept up to 500 <br /> tons of waste per day. ) PHS granted Forward such interim relief <br /> in a Notice and Order dated August 7, 1990. The Notice and Order <br /> allows Forward to accept up to 500 tons (2000 cubic yards) per day, <br /> with a daily peak of 550 tons (2200 cubic yards) , while Forward is <br /> revising its SWFP. In addition, the Notice and Order specifically <br /> allows Forward to accept asbestos, ash, contaminated soils (with <br /> prior regulatory approvals) , water/sewage sludge and shredder waste <br /> during this period. Forward has taken the position that the SWFP <br /> already allowed the acceptance of all of the materials specifically <br /> listed in the Notice and Order. <br /> 3 . Waste Discharge Requirements Order No. 89-148 ("WDRU. <br /> The WDR was issued in 1989 by the Regional Board. It recognizes <br /> eight Waste Management Units ("WMUs") at the Landfill, including <br /> WMU A which contains hazardous wastes and has undergone closure. <br /> WMUs B, C, D and H are classified as Class III (containing wastes <br /> that are non-hazardous and non-designated) , and WMUs E, F and G are <br /> classified as Class II (containing designated wastes, meaning that <br /> the State has granted a hazardous waste variance or the wastes <br /> could cause degradation of waters if improperly managed) . Pursuant <br /> to the WDR, the Landfill may accept non-hazardous petroleum <br /> hydrocarbon-contaminated soil (which must first be treated at the <br /> Landfill 's treatment unit if the contamination is above certain <br /> concentrations) , non-hazardous solid wastes that are below <br /> designated levels specified in the WDR, sewage and water treatment <br /> sludges, asbestos, coal and wood ash, shredder waste, and other <br /> designated wastes approved on a case-by-case basis by the Regional <br /> Board. WMU G is dedicated to soil treatment. A temporary WMU F <br /> is intended to store leachate from the other WMUs. A permanent WMU <br /> F would store liquid designated wastes that are compatible with the <br /> synthetic liner. <br /> REVISION OF PERMITS <br /> 1. The Use Permit. The only significant revision to the Use <br /> Permit that would appear to be necessary is a provision allowing <br /> the daily volume to exceed 500 tons, in conformance with the volume <br />
