The following is an itemized list of underground storage tank violations that have not <br /> been addressed for TRACY SHELL as of March 10, 2023. <br /> Open violations from January 30, 2023 inspection <br /> Violation #214 - Failure to comply with UST operating permit conditions. <br /> OBSERVATION <br /> -The 91 relay was repaired on 12/1 /2022 and the EHD was not notified. <br /> -According to the service technician and manager onsite, the 89 tank was converted to 87 and pipes were <br /> manifolded at the dispenser. A notification was not provided to the EHD. <br /> REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be <br /> performed by a properly licensed, trained , and certified contractor pursuant to the EHD's policy and a permit <br /> obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by <br /> the EHD prior to beginning work. <br /> CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the replacement of the 91 relay and tank <br /> conversion . A " Failure to Obtain a Permit" penalty applies. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation : <br /> Violation #305 - Failed to maintain secondary containment (e.g, failure of secondary containment testing). <br /> OBSERVATION The 4/2/2019 and 4/15/2022 secondary containment test results indicated failures on the 87-1 , <br /> 87-21 91 , and diesel lines, sumps and UDCs, The failed components have not been repaired or replaced. <br /> REGULATION GUIDANCE: All underground storage tanks shall be designed and constructed to provide secondary <br /> levels of containment for all hazardous substances released from primary containment. <br /> CORRECTIVE ACTION: Immediately contact a properly licensed, trained, and certified contractor to install <br /> secondary containment under permit and inspection of the EHD. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation : <br /> Violation #318 - Failed to meet spill container requirements. <br /> OBSERVATION The diesel spill container was not capable of containing five gallons for product delivery operations <br /> upon arrival. Approximately, 5 gallons of liquid was observed in the diesel spill container prior to testing . <br /> REGULATION GUIDANCE: All spill containers shall have a minimum capacity of five gallons. <br /> CORRECTIVE ACTION: The liquid was removed and the spill container was tested.
