4. The location, size, design, and operating characteristics of the proposed use will be compatible with <br /> and will not adversely affect the livability or appropriate development of abutting properties and the <br /> surrounding neighborhood. <br /> • This finding can be made because the project has been conditioned to meet San Joaquin <br /> County Development Title regulations that protect public health, safety, and welfare and <br /> ensure that the project will not adversely affect the livability or appropriate development of <br /> abutting properties and the surrounding neighborhood. All project development will meet <br /> required setbacks to prevent intrusion onto adjacent properties. Adjacent properties are <br /> approved for, or have applied for, truck parking lots and other heavy equipment storage. <br /> The nearest residence is located approximately 35 feet to the east of the project site. To <br /> prevent noise levels from exceeding the standards specified in Development Title Table 9- <br /> 404.040, which could potentially impact nearby residences, the proposed project is subject <br /> to the provisions of the San Joaquin County noise ordinance(Development Title Section 9- <br /> 404.030) and will have to comply with noise level limitations. Conditions include a 10-foot- <br /> wide landscape buffer and a 6-to 8-foot-tall masonry wall along the property line abutting <br /> the residential use. As a result, the proposed project is a compatible use that is not <br /> anticipated to adversely affect abutting properties or the neighborhood. <br /> 5. The proposed use will not create any nuisances arising from the emission of odor, dust, gas, noise, <br /> vibration, smoke, heat or glare at a level exceeding ambient conditions. <br /> • This finding can be made because there are no potentially significant impacts from odor, <br /> dust,gas, noise,vibration,smoke, heat or glare that will require mitigation.Additionally,the <br /> project involves minor alterations in the condition of land, water and vegetation. The <br /> development will be subject to the rules and regulations of the San Joaquin County <br /> Development Title, the Air Pollution Control District, and the State Water Quality Control <br /> Boards and is required to obtain permits for construction and operation of the development. <br /> Additionally, as noted above,the project will be subject to the noise standards contained in <br /> the Development Title. Therefore,the project will not create a nuisance. <br /> 6. The site of the proposed use is adequately served by highways, streets, water, sewer, storm drainage, <br /> and other public facilities and services. <br /> • This finding can be made because the project site is located on a public road and is <br /> approximately 0.25 miles from the East Fremont Street/State Route 99 interchange to <br /> provide easy travel access to the project site. Adequate utilities, sanitation, and drainage <br /> will be provided with onsite services as is permitted. <br /> 7. The proposed use complies with all applicable provisions of this Title. <br /> • This finding can be made because the subject property is zoned I-L (Limited Industrial) and <br /> the proposed uses (Use Types: Truck Services-Parking, Repairs, Sales and Rentals; <br /> Industry-Limited; Construction Services-General and Heavy Infrastructure; Auto Repair <br /> Limited and Major; Agricultural Warehousing; and Equipment Sales, Repair, and Storage, <br /> Farm Machinery Sales and Repair), are allowed uses with a conditionally approved <br /> Administrative Use Permit. The recommended Conditions of Approval will ensure that the <br /> project complies with all applicable provisions of the Development Title. <br /> PA-2200274— Findings 2 <br />
