FINDINGS FOR SITE APPROVAL
<br /> 1 . The proposed use is consistent with the goals , policies , standards , and maps of the General Plan , any
<br /> applicable Master Plan , Specific Plan , and Special Purpose Plan , and any other applicable plan adopted
<br /> by the County .
<br /> • This finding can be made because the Wineries and Wine Cellars = Small Winery use type
<br /> may be conditionally permitted in the AG -40 ( General Agriculture , 40 -acre minimum ) zone ,
<br /> which is an implementing zone for the A /G ( General Agriculture ) General Plan Designation .
<br /> The events proposed as accessory to the winery include Small - Scale Accessory Events
<br /> without outdoor amplified sound , and Marketing Events , Wine Release Events , and Large =
<br /> scale Accessory Winery Events with outdoor amplified sound . These events would all be
<br /> subject to the rules and regulations of the Development , including noise level standards .
<br /> Additionally , pursuant to General Plan Goal ED -5 , the County is tasked with providing a
<br /> variety of tourism opportunities to market San Joaquin County as a tourist destination and
<br /> expand the local economy . Specifically , Goals ED -5 . 1 Agritourism and ED -5 . 2 Local Winery
<br /> Awareness , state that the County shall encourage existing and new incidental agritourism
<br /> opportunities that are directly associated with surrounding agricultural products and also
<br /> support local efforts to raise awareness of the County ' s wine regions among individuals in
<br /> the wine trade , media , and wine consumers . The proposed winery events would provide an
<br /> agritourism opportunity incidental to the production of wine , which is an agricultural
<br /> product , and would help raise awareness of the region among wine consumers . As a result ,
<br /> the proposed addition of events to the existing winery , including events with outdoor
<br /> amplified sound , is consistent with the goals , policies , standards and maps of the General
<br /> Plan , and there are no Master Plans , Specific Plans , Special Purpose Plans , or any other
<br /> applicable plan adopted by the County in the vicinity .
<br /> 2 . Adequate utilities , roadway improvements , sanitation , water supply , drainage , and other necessary
<br /> facilities have been provided , and the proposed improvements are properly related to existing and
<br /> proposed roadways .
<br /> • This finding can be made because the existing services and improvements related to the
<br /> winery , along with the improvements required with the recommended Conditions of
<br /> Approval for the proposed events are adequate . The project will be served by an existing
<br /> private septic system , an individual well , and on -site storm drainage .
<br /> 3 . The site is physically suitable for the type of development and for the intensity of development .
<br /> • This finding can be made because the 16 -acre parcel is of adequate size and shape to
<br /> accommodate the existing winery and proposed revision to allow the addition of 36 events ,
<br /> to include : 10 Small -scale Accessory Winery Events for a maximum of 80 attendees , 12
<br /> Marketing Events for a maximum of 150 attendees , 4 Wine Release Events for a maximum
<br /> of 150 attendees , 10 Large Scale Accessory Wine events with a maximum of 80 attendees
<br /> and 10 Small Scale Accessory Events for a maximum of 80 attendees . As required by
<br /> Development Title Table 9 - 1015 . 3 ( b ) and Development Title Section 9 = 1075 . 9 ( h ) ( 1 ) , the
<br /> winery is required to provide 2 . 5 parking spaces per 1 , 000 square feet of building area and
<br /> 1 parking space for every 2 attendees . The winery currently has 5 , 998 square feet of building
<br /> square footage and is requesting events for up to 150 attendees . This would require the
<br /> winery to provide 81 combined permanent and overflow parking spaces . The site plan
<br /> depicts 40 permanent parking spaces and 47 overflow parking spaces , which is more than
<br /> what is required under the current Development Title . The existing winery operation site is
<br /> also physically suitable for the proposed addition of amplified sound for events , as long as
<br /> the sound system speakers are located and oriented as noted in Figure 3 of the
<br /> Environmental Noise Assessment dated August 25 , 2022 and limited to the maximum noise
