InspecƟon reports were received via email later that day <br /> <br />February 24, 2022 - SJCEHD noƟfied Valley Pacific via email that the report will be revised to include more details in the <br />exisƟng violaƟons <br /> <br />March 1, 2022 - SJCEHD emailed an amended HW inspecƟon report <br /> <br />March 2, 2022 - SJCEHD noƟfied Valley Pacific via email that SJCEHD is looking into the potenƟal tank in an underground <br />area (TIUGA) and will reach out to Valley Pacific with more informaƟon. <br /> <br />March 30, 2022 - Valley Pacific emailed completed RTC documentaƟon for both HW and APSA programs. <br /> <br />April 5, 2022 - Valley Pacific followed up via email with SJCEHD to see if any further acƟon was required. SJCEHD <br />confirmed no further requests at this Ɵme <br /> <br />May 9, 2022 - Valley Pacific followed up with SJCEHD via email to see if any further acƟon was required. SJCEHD <br />confirmed no further requests at this Ɵme <br /> <br />June 6, 2022 - Valley Pacific provided an electronic copy of the SPCC Plan to SJCEHD via email for review. The email <br />included our understanding that all documented HW and APSA violaƟons had been addressed and corrected. The <br />installaƟon of the berm idenƟfied in the completed SPCC Plan update would be completed by October 31, 2022. <br /> <br />October 3, 2022 - Valley Pacific provided SJCEHD an update and photographs of the completed berm already included in <br />the June 2022 revised SPCC Plan. The email included a request to acknowledge a successful return to compliance. <br />SJCEHD responded that it is being forwarded to a lead supervisor for review. <br /> <br />February 27, 2023 - 10:19am: SJCEHD emailed Valley Pacific that APSA violaƟons 301 and 712 were sƟll open and <br />requested proof that items were addressed in the SPCC Plan. 10:17pm: Valley Pacific provided previous emails and a <br />brief statement of understanding indicaƟng these violaƟons had already been addressed. <br /> <br />March 3, 2023 - Hardcopy noƟces from SJCEHD were received by Valley Pacific regarding open violaƟons including HW <br />ViolaƟon #502 and APSA ViolaƟons #301, #712. <br /> <br /> <br /> <br />ViolaƟons Response <br />HW ViolaƟon #502 - Tank system inspecƟons of discharge systems, monitoring equipment, and tank levels not done <br />daily. <br /> <br />According to the RTC LeƩer from March 30, 2022, this violaƟon had been addressed. The text from the RTC leƩer is <br />included below "InspecƟons of the waste oil tank (SPCC Plan - AST-8) are conducted consistent with Hazardous waste <br />regulaƟons. Site personnel responsible for inspecƟons have been trained on the hazardous waste container inspecƟon <br />requirements. The training roster has been included for reference." <br /> <br />Valley Pacific received no response from SJCEHD unƟl receiving the noƟce dated February 27, 2023.
