Complaint Investigation Summary Report #: 5105 COMPLAINT ID: COTTOOND2 Site Location: 12988 W MCDONALD ROAD Activity Summary Activity Date Recorded by 11/30/2021 At approximately 7.25pm received a spill report Cal DES Control #21-6813 for a NSO diesel spill at 12988 West McDonad Rd Stockton (Tiki Lagoon & Resort Marina). Time of incident 1903pm. Google facility name and called 209 941 8975, talk to Dan Dumas the Owner and I asked him about the incident, he stated that there was no diesel spill at the property and he further said the Coast Guard came and checked and found nothing. He believe somebody maybe trying to discredit his business. I called the Coast Guard on duty phone 415 370 0043 and 707 374 2871 the officer said the spill report was received and no one had been to the site. The Coast Guard gave me the phone number of the person (775 301 3909) who called to report the incident. I called that number and introduced myself and I asked his name, he said John , I asked for his last name he did not disclose and he said he taught the complaint was anonymous caller. I told him we cannot release his names to the Public and however said ok and lets continue with what happened he stated that he was out smoking at the Marina and saw diesel sheen all over the Marina that workers of the Marina pumped diesel from a boat on the water and I ask him at what time he said from about 10.00am and added that the owner is not doing anything about it and he owns the boat. At about 9.15pm I received a pager from the San Joaquin General Hospital and called back the person on duty and she stated that Sheriffs department asked her to page Environment Health and find out if they received a spill report. I asked for the officer's phone number and I was given -916 862 2968. At 9.31pm I called the officer and acknowledge receipt of the spill report. The officer said he received a phone call from one lady complaining about the diesel spill and said the lady has videos, I asked for the phone number of the lady and two minutes later the officer called me and gave the number 209 256 5456 I told the officer I was still gathering information about the spill and I might visit the site hoping I will be able to see the diesel sheen though it was dark. At 9.40pm I called the lady (209 256 5456) she said she leaves at the Marina and diesel sheen is all over the water and the Owner is not doing anything about it, she has two videos I requested she send me the videos. She said one other lady at the dock has the videos her number 209 561 1116 and at 9.42pm I received a video from 530 744 5017. I let her know that something will be done about the incident. I briefed my lead Senior Haza he requested a copy of the spill report and I sent it to him, and we discussed the different scenarios and concluded that it was dark and even if I visit site, I will not be able to see the diesel sheen and that first thing in morning we start with that complaint. 5105 rpt Page 2 of 4
