Complaint Investigation Summary <br /> Report #: 5105 <br />COMPLAINT ID: COTTOOND2 Site Location: 12988 W MCDONALD ROAD <br />Activity Summary <br />Activity Date Recorded by <br />12/01/2021 Create complaint, and Prop 65. NSO <br />Arrived on site with Kristina Saetem, met and discussed with Miguel Vera (209 <br />623 6904), Miguel Vera Jr (209 623 3622), Maintenance workers and Dan Dumas <br />(510 912 4276, facility owner. They all stated "we are not aware of any red dyed <br />diesel release on the water at the Marina". We contacted one lady who leaves at <br />one of the facility dock tel 209 561 1116 and she indicated the boat that workers <br />for the Marina pumped the boat's fuel tank full of water causing it to overflow and <br />discharge an unknown amount of diesel fuel overboard. We made a work through <br />of the facility and observed dyed diesel sheen at Dock E #15, 16 ,17 and at Dock <br />D entrance. The red dyed diesel sheen had spread all over the water at the <br />Marina. A large amount of the dyed diesel sheen was observed at dock E, #16-C1 <br />leaking from the abandoned boat. We observed dyed diesel sheen on vegetation <br />and smell gasoline like odor at the abandoned boat area. We requested absorbent <br />pads and booms be applied around the abandoned boat and impacted areas of <br />the Marina. The Owner Dan Dumas ask his maintenance workers to remove all <br />the red dyed diesel from the abandoned boat tank. The Maintenance workers <br />were actively siphoning red dyed diesel from tank of the abandoned boat and <br />securing in containers. We notified Coast Guard, and Fish and Wildlife with some <br />photos of the dyed diesel spill areas. According to Dan Dumas (Owner) he has <br />been working with the DMV and the Sheriff's department to obtain documentation <br />to remove the abandoned boat that has not moved for years. He stated further that <br />he bought the facility in October 2021. <br />Booms and absorbent pads were applied on impacted areas. <br />Prepared A Notice to Abate and e mailed to Dan Dumas <br />(dan.tikilagoonresort@gmail.corn). <br />By the time we left the facility approximately 60 gallons of red dyed diesel was <br />removed from the abandoned boat tank. <br />12/02/2021 Two Phone calls and text messages to owner Dan Dumas to verify if he had the NSO <br />abandoned boat number, he stated that he did not have it, he will have to find out <br />from lien sale company. He also acknowledge receipt of the Notice to Abate. <br />12/07/2021 Phone call Miguel Jr 209 623 3622 to verify cleanup. He stated that clean up was NSO <br />completed and absorbent pads and booms were in waste drums waiting to be <br />picked up. Not sure when drums will be picked up. I let him know that I will stop by <br />to verify clean up during the week. <br />12/08/2021 Discuss hazardous waste inspection appointment with John Alaniz (REHS) for NSO <br />12/9/2021 and also verify clean up of spill that occurred on 11/30/2021.. <br />12/09/2021 Photo log of diesel spill observed on 12/01/2021 NSO <br />12/09/2021 On site with REHS John Alaniz to verify clean up and conduct a routine hazardous NSO <br />waste inspection. We saw water of the Marina and vegetation clear with no diesel <br />sheen . Miguel Vera Jr (Maintenance) stated approximately 80 gallons of red dyed <br />diesel was pumped out of the abandon boat. <br />Two drums 55 gallons each (110gallons) of waste was generated from clean up <br />operation. Could not verify disposal records because owner (Dan Dumas) was not <br />present. Called owner he was in a meeting and stated we obtain an appointment. <br />An appointment was scheduled for a routine hazardous waste inspection for <br />Wednesday 12/15/2021 at 9.00am. <br />12/09/2021 Photo log clean up verification.
