Submit a copy of the test/inspection results and correction to the code cited for section 2.5 to the EHD. <br />This is a Class II violation. <br /> 716 CFR 112.8(c)(8)(v) Failed to regularly test liquid level sensing devices to ensure proper operation. <br />OBSERVATION: Per Section 3.3 in the SPCC Plan all tanks have Level Alarm High High Alarms and Level Switch <br />High High floats. Per Compliance Manager - Patrick Samson, liquid level sensing devices for all of the tanks have <br />not been tested. <br />REGULATION GUIDANCE: 112.8(c)(8)(v) You must regularly test liquid level sensing devices to ensure proper <br />operation. <br />CORRECTIVE ACTION: Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be <br />regularly tested to ensure proper operation. Immediately conduct all necessary testing of all liquid level sensing <br />devices to ensure proper operation. Submit proof of correction to the EHD. <br />This is a Class II violation. <br /> 718 CFR 112.8(c)(10) Failed to promptly correct visible discharges and/or remove accumulations of oil in diked areas. <br />OBSERVATION: The facility failed to promptly correct visible discharges of oil from: <br />- The distillation area where T-315 is located. Orange-brown liquid was observed in the containment. The <br />orange-brown liquid led to a drain. <br />- The tank farm area where T-613 is located. Brown liquid was observed in the containment. The liquid lead to a <br />drain. <br />- Biodiesel storage tank farm area. Orange-brown liquid observed throughout containment. The liquid lead to a <br />drain. Per compliance manager, the pipes in this area were replaced 3 weeks ago and liquid could potentially be <br />from that replacement. <br />REGULATION GUIDANCE: 112.8(c)(10) Promptly correct visible discharges which result in a loss of oil from the <br />container, including but not limited to seams, gaskets, piping, pumps, valves, rivets, and bolts. You must promptly <br />remove any accumulations of oil in diked areas. <br />CORRECTIVE ACTION: Immediately remove accumulation in the containment areas, and manage all wastes <br />according to the California Code of Regulations Title 22 hazardous waste regulations, submit proof of correction to <br />the EHD. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />An inspection checklist was provided to the facility operator on the day of inspection (12/8/2022). A complete <br />report was finished on 3/30/2023 and replaces the initial checklist sent on 12/8/2022.
