<br />CANARY Renewables Corp. 809 C Snedeker Avenue, Stockton, CA 95203 USA <br /> <br />April 28, 2023 <br /> <br />Carol Presto, REHS <br />John Alaniz, REHS <br />San Joaquin Environmental Health Department <br />1868 E Hazelton Avenue <br />Stockton CA 95205 <br /> <br />Subject: Notice of Violation from Hazardous Materia Program Inspection Report <br /> <br />Dear Ms. Presto and Mr. Alaniz: <br /> <br />Below is an update regarding the issues your department had identified on your site visit on <br />December 8, 2022: <br /> <br />Item # 103 - We already submitted the HMBP and Annual Facility Tank Statement in CERS on <br />1/11/23 <br /> <br />Item # 112 - We already completed and maintained a Substantial Harm Criteria certificate <br />which was signed on 1/6/23 <br /> <br />Item # 203 - We already updated and implemented our SPCC Plan. Monthly inspection on the <br />mentioned tanks were conducted starting on 1/27/23 monthly inspection. The rocks blocking <br />the drainage has been removed. Drip pans were inspected and moved to the warehouse. <br /> <br />Item # 205 – Testing of liquid level devices is discussed in the draft SPCC Plan dated April 27, <br />2023 in Section 2.3(8), page 17. <br /> Facility personnel are present during product transfer to monitor tank fill level and <br />liquid level sensing devices shall be checked to be legible and in good working condition during <br />monthly tank inspections. <br /> <br />Item # 302 – A site evaluation was conducted on September 13, 2022 to prepare the updated <br />SPCC Plan. See the draft SPCC Plan awaiting PE review dated April 27, 2023. <br /> <br />Item # 601 –#1 The cross reference matrix was updated in the draft SPCC Plan dated April 27, <br />2023. <br /> #2 Management approval was signed on 1/6/23 <br /> <br />Item # 604 – T-127, methanol storage tank, does is not oil and is not subject to SPCC or APSA. <br />The 550-gallon diesel tank was included in Canary’s previous SPCC Plan dated June 20, 2022 in <br />Table A, Table B and F2 – Facility Diagram.
