Environmental Health Department <br />AMENDED <br />3/30/2023 <br />Aboveground Petroleum Storage Act Inspection Report <br />Date: <br />December 08, 2022 <br /> Facility Address: <br /> 809C SNEDEKER AVE, STOCKTON <br /> Facility Name: <br /> CANARY RENEWABLES CORP <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 112 CFR 112.20(e) Failure to complete and maintain a Substantial Harm Criteria certification. <br />OBSERVATION: The facility failed to complete and maintain (at the facility) a complete Substantial Harm Criteria <br />certification form. The Substantial Harm Criteria was not signed by the owner/operator. <br />REGULATION GUIDANCE: 112.20(e) If the owner or operator of a facility determines pursuant to paragraph (a)(2) <br />of this section that the facility could not, because of its location, reasonably be expected to cause substantial harm <br />to the environment by discharging oil into or on the navigable waters or adjoining shorelines, the owner or operator <br />shall complete and maintain at the facility the certification form contained in appendix C to this part and, in the event <br />an alternative formula that is comparable to one contained in appendix C to this part is used to evaluate the criterion <br />in paragraph (f)(1)(ii)(B) or (f)(1)(ii)(C) of this section, the owner or operator shall attach documentation to the <br />certification form that demonstrates the reliability and analytical soundness of the comparable formula and shall <br />notify the Regional Administrator in writing that an alternative formula was used. <br />CORRECTIVE ACTION: Complete and maintain at the facility a completed Substantial Harm Criteria certification <br />form. Submit proof of correction to the EHD. <br />This is a Class II violation. <br /> 203 CFR 112.3 Failure to implement the SPCC Plan. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as <br />required. <br />- Monthly inspections are not being conducted on tanks T-116, T-100, and petroleum filled drums per SPCC Plan <br />Table C <br />- Rocks were blocking the drainage ditch along the north side of the property, not allowing for sufficient storm water <br />drainage per SPCC Plan Section 3.2 <br />- Per SPCC Plan Section 2.6, formal integrity inspection reports are to be maintained at the facility for the life of the <br />tank but all integrity inspection reports were not observed on site. <br />- Per SPCC Plan Section 2.9, drip pans or buckets are placed below hose connections for transfers over an <br />non-impervious surface. The drip pads were observed in the secondary containment with water accumulation. The <br />current storage of these drip pads may affect the integrity of their purpose to prevent spills during transfers. <br />REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section <br />must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” <br />or “Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall <br />conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section <br />112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill <br />prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the <br />regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the <br />Code of Federal Regulations. <br />CORRECTIVE ACTION: Implement the SPCC plan, as required.
