Environmental Health Department <br />AMENDED <br />3/30/2023 <br />Aboveground Petroleum Storage Act Inspection Report <br />Date: <br />December 08, 2022 <br /> Facility Address: <br /> 809C SNEDEKER AVE, STOCKTON <br /> Facility Name: <br /> CANARY RENEWABLES CORP <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 205 CFR 112.3, 112.6 Failure to prepare SPCC Plan that meets all applicable requirements. <br />OBSERVATION: The facility failed to prepare an SPCC Plan that meets all applicable requirements. <br />Per Section 3.3 in the SPCC Plan all tanks have Level Alarm High High Alarms and Level Switch High High floats. <br />The SPCC Plan fails to discuss testing of liquid sensing devices [112.8(c)(8)(v)]. <br />Standard to be followed was not listed in the SPCC plan for the following tanks [112.8(c)(6)]: <br />- T-619 <br />- T-127 <br />- Diesel Tank in the tank farm located in front of T-612 <br />The SPCC Plan failed to discuss marking terminal connection as to origin when piping is not in service or is in <br />standby service for an extended time [112.8(d)(2)] <br />REGULATION GUIDANCE: 25270.4.5 (a) Except as provided in subdivision (b), the owner or operator of a storage <br />tank at a tank facility subject to this chapter shall prepare a spill prevention control and countermeasure plan <br />applying good engineering practices to prevent petroleum releases using the same format required by Part 112 <br />(commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations, <br />including owners and operators of tank facilities not subject to the general provisions in Section 112.1 of those <br />regulations. An owner or operator specified in this subdivision shall conduct periodic inspections of the storage tank <br />to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the <br />Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or <br />operator specified in this subdivision shall fully comply with the latest version of the regulations contained in Part 112 <br />(commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br />112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and <br />implement a Spill Prevention Control and Countermeasure Plan in accordance with § 112.7 and any other <br />applicable section of this part. <br />CORRECTIVE ACTION: Ensure that facility's SPCC plan meets all applicable requirements, including discussion of <br />testing of liquid sensing devices, all testing standards for each tank, and discussion of terminal connections and <br />transfer points being marked as to origin when piping that is not in service or is in standby service for an extended <br />time.
