California Integrated Waste Management Board <br /> Permit Decision No. 94-68 <br /> July 27 and 28, 1994 <br /> WHEREAS, the Forward, Inc. owns and operates the Forward <br /> Landfill; and <br /> WHEREAS, the San Joaquin County Environmental Health <br /> Division, acting as the Local Enforcement Agency (LEA) , requested <br /> that the operator submit an application for a revised Solid Waste <br /> Facility Permit; and <br /> WHEREAS, the San Joaquin County Community Development, the <br /> lead agency for CEQA review, prepared an Environmental Impact <br /> Report (EIR) for the proposed project; and Board staff provided <br /> comments to the County on December 20, 1992; and the proposed <br /> project will have a significant effect on the environment; and <br /> mitigation measures were incorporated into the approval of the <br /> proposed project; and the San Joaquin County Board of Supervisors <br /> adopted the Final EIR (SCH# 92032013) on September 16, 1993 , and <br /> approved the Notice of Determination for the project on <br /> September 29, 1993 ; and <br /> WHEREAS, new Waste Discharge Requirements (WDRs) were <br /> adopted by the Central Valley Regional Water Quality Control <br /> Board (CVRWQCB) on January 28, 1994; and <br /> WHEREAS, the operator has completed an approved <br /> demonstration project evaluating the use of synthetic fabric <br /> tarps as alternative daily cover; and <br /> WHEREAS, the LEA has submitted to the California Integrated <br /> Waste Management Board (Board) for its review and concurrence in, <br /> or objection to, a revised Solid Waste Facilities Permit for the <br /> Forward Landfill; and <br /> WHEREAS, the project description in the CEQA document is <br /> consistent with the proposed permit; and <br /> WHEREAS, Board staff have evaluated the proposed permit for <br /> consistency with the standards adopted by the Board and found the <br /> facility design and operation in compliance with State Minimum <br /> Standards; and <br /> WHEREAS, the Board finds that all state and local <br /> requirements for the proposed permit have been met, including <br /> consistency with Board standards, conformance with the County <br /> Solid Waste Management Plan, consistency with the County General <br /> Plan, and compliance with CEQA; and <br /> WHEREAS, there is no evidence in the record to indicate that <br /> the issuance of the permit would prevent or substantially impair <br /> the jurisdictions, achievement of the diversion requirements <br /> prescribed in Public Resources Code Section 41780; and <br />
