At issue is whether <br /> construction of the unit can begin before the final design report is completed. The letter correctly notes <br /> that portions of the design were submitted to us and approved last summer as part of the D98 design <br /> report. Forward plans to limit new construction to those portions of the project previously approved as <br /> part of D98. Forward will not construct any additional D99 components until revised designs for D99 <br /> are completed and approved by Board staff. <br /> Although full design plans are preferable,I concur with your proposed schedule for this unit in this case. <br /> Please note that Provision E.3. in the facility's waste discharge requirements specifically requires <br /> submittal and approval of design plans prior to their implementation. Therefore, delay in submittal of the <br /> design report may delay construction of the additional D99 components. <br /> The schedule submitted with your letter does not include the new surface impoundment WMU F.
