The trust was established in 1990 to provided financial assurance for the closure and post- <br /> closure care of the landfill unit as required by Chapter 15 (now Title 27). I also have a copy of the <br /> 5 April 1999 letter from the California Integrated Waste Management Board that authorizes your bank <br /> to terminate this account. <br /> At the time the trust was established,the facility's design plans showed the ash pit closing separately <br /> from the surrounding units. Subsequently,the facility's design evolved so that the ash pit will be <br /> overlapped by the adjacent Class II landfill units and closed with a single cap over the contiguous units. <br /> Forward provided separate financial assurance mechanisms (performance bond numbers 7868-FP and <br /> 7869-FP) for closure of these overlapping landfill units. This resulted in two financial mechanisms for <br /> closure of the area occupied by the ash pit. <br /> Therefore,we concur with your request, and the Waste Board's authorization,to terminate the original <br /> trust agreement for the Eastern Ash Pit, account number 62-00-2037-23-2.
