Complaint Investigation Summary <br /> Report #: 5105 <br />COMPLAINT ID: C00053723 Site Location: 705 W WEBER AVE <br />Activity Summary <br />Activity Date Recorded by <br />05/04/2021 Discussed storage for diesel-contaminated waste absorbent with Lead Senior MURO <br />Garrett Backus. <br />MURO <br />MU RO <br />MURO <br />MURO <br />MURO <br />MURO <br />MURO <br />MURO <br />05/05/2021 Chris Magro stated the pads with the fuel in them were triple bagged Phillip <br />DeVaughn took all of that to the HHW disposal center. <br />05/12/2021 Received an email from Phillip DeVaughn with a scan of the Prop 65 attached. <br />Email message was: "Please see attached". <br />Replied. Asked if he has questions on the Prop 65. Requested disposal records <br />for the solid waste and scheduling information for removal of the boat. <br />05/13/2021 Received 2 phone calls from Phillip DeVaughn regarding the sunken boat. <br />05/18/2021 Returned Officer Ryan Rodriguez (CDFVV) call. Discussed boat owner's inability to <br />pay for boat removal from under water. <br />05/24/2021 Updated Fred since he was CT on the day we received the initial notification. <br />07/02/2021 Received an invoice from accounting during my absence on 6-21-21. Invoice <br />addressed to Phillip DeVaughn, 71 Tenth St, Oakland, CA 94607 was returned to <br />EHD by US Post Office with notes: Attempted - Not Known - Unable to Forward. <br />Emailed Chris Magro to request mailing address from Phillip DeVaughn. <br />Notified accounting that email was sent and I will provide update as soon as I <br />receive it. <br />07/02/2021 Emailed Chris Magro to ask if the boat has been removed from the water, if it is <br />leaking diesel, and if the hard boom was still in place. <br />07/06/2021 Received update from Chris Magro via email. <br />Mr DeVaughn failed to get his boat raised as we required and has not responded <br />to calls or emails for quite some time. He has been sent notification to remove his <br />boat from the marina by no later than 07/30/21 after which time it shall be <br />conclusively deemed abandoned and as provided in the Marina Wharfage <br />Agreement, the Marina shall become entitled, without liability, to dispose of the <br />vessel in any manner and by any means. <br />The vessel has not leaked any diesel since the original time of sinking which as <br />you are aware was contained, removed, and disposed of.
