Complaint Investigation Summary <br /> Report #: 5105 <br />COMPLAINT ID: C031SZOIY Site Location: 720 S B ST <br />Activity Summary <br />Recorded by <br />ALANIZ <br />Activity Date <br />02/21/2021 TIME SPENT: 10:24 A.M.-3:48 P.M. <br />10:24 a.m.: Received a page from San Joaquin General Hospital. Called and <br />received information regarding a release of diesel at a BNSF railyard. Received <br />CalOES spill report 21-0969. Called the main BNSF line, 817-593-6823 and was <br />directed to call James Earner, BNSF Hazmat, 909-267-5167. <br />10:42 a.m.: Called James and discussed the incident. Velocity Rail Solutions <br />(Velocity) overfilled locomotive #175 causing the release of approximately 15 <br />gallons of red-dyed diesel fuel onto the ground. James said that he hired US <br />Ecology to clean the spill and work with Velocity to properly dispose of the waste. <br />James then directed to talk with the Velocity manager on site, Cory Clapp, <br />720-417-3873. <br />10:53 a.m.: Called Cory and discussed the incident. Cory said that the spill was <br />contained to asphalt. He said he was going to do some cleanup before US <br />Ecology arrived on site. I explained to him that I would be going to inspect the <br />area and that I would be writing him a notice to abate. He said he would inform <br />me when Ecology was expected to arrive on site. They were expected to arrive on <br />site within 2 hours of being called out. <br />11:06 a.nn.-11:48 a.m: Created a complaint and started to type up the notice to <br />abate. <br />12:00 p.m.: Received a call from Cory. He applied "Micro-Blaze" to the area and <br />pressure washed it. He did not suck up any waste liquid. Cory thought that the <br />"Micro-Blaze" made the diesel spill non-hazardous. Left for the site and arrive at <br />12:56 p.m. <br />Red-dyed diesel was released onto asphalt from locomotive 175 on the west side <br />of the yard. The spill area was approximately 10x15 feet. An oily sheen was <br />observed on top of the pressure washed area. The pressure wash water went <br />underneath the train. I could not fully observe if the rail track was contaminated. <br />Jose Salazar with US Ecology arrived on site at approximately 1:30 p.m. He said <br />he would re-pressure wash the area with degreaser and suck up the waste water. <br />After that he would have the train moved and clean the track. All of the waste <br />generated would be stored on site until a complete profile could be generated for <br />proper disposal. <br />Typed up the notice to abate and emailed it to Cory at <br /><cory.clapp@velocityrail.com>, and the safety manager, Fernando Arredondo, at <br /><fernando.arredondo@velocityrail.com>. Confirmed that he received it. <br />Discussed making a complete hazardous waste determination with him. It was <br />unknown how long it would take to move the train. Left the site at 2:15 p.m. and <br />arrived back home at 3:00 p.m. <br />3:00 p.m.: Called Jose and he said the pressure washing was completed and that <br />BNSF was in the process of moving the train. Asked him to update me on how <br />the track looked like when the train was removed. <br />3:06 p.m.: Called Cory told discussed what the contractor had told me. <br />3:54 p.m.: Called Jose and asked for an update. Left a message. <br />4:54 p.m.: Called Jose again. Could not reach him. Called Cory and asked him to <br />find out what was going on. <br />5:12 p.m-5:30 p.m.: Messaged Cory asking for an update. Received a call from <br />him. I explained what I needed to see for cleanup. <br />5105 rpt Page 2 of 3
