This condition can be exacerbated by acidic soils and <br /> excess moisture. If reducing conditions do not reverse as the percolate moves <br /> down through the vadose zone, the dissolved metals (primarily iron, manganese, <br /> and arsenic) can degrade shallow groundwater quality. Many aquifers contain <br /> enough dissolved oxygen to reverse the process. <br /> Salt and Nitrate Control Program Reopener <br /> 91. On 31 May 2018, the Central Valley Water Board adopted Basin Plan <br /> amendments incorporating the Salt Control Program (SCP) and Nitrate Control <br /> Program (NCP). The State Water Board conditionally approved the amendments <br /> on 16 October 2019 (State Water Board Resolution 2019-0057). The effective <br /> date of the Basin Plan amendments was 17 January 2020, the Notice of Decision <br /> filing date following approval by the Office of Administrative Law (OAL) (OAL <br /> Matter No. 2019-1203-03). For those components subject to United States <br /> Environmental Protection Agency (USEPA) approval, the effective date was 2 <br /> November 2020. On 10 December 2020, the Central Valley Water Board <br /> adopted revisions to the Basin Plan amendments (Resolution R5-2020-0057). <br /> The State Water Board conditionally approved these revisions on 1 June 2021 <br /> (State Water Board Resolution 2021-0019). The effective date of the revisions to <br /> the Basin Plan amendments was 10 November 2021, the Notice of Decision filing <br /> date following OAL approval (OAL Matter No. 2021-0929-05S). Surface-water <br /> related revisions to the Basin Plan amendments are pending USEPA approval. <br /> The overarching goals and priorities of these programs are to (1) ensure safe <br /> drinking water supply; (2) reduce salt and nitrate loading so that ongoing <br /> discharges neither threaten to degrade high quality waters absent findings by the <br /> Central Valley Water Board nor cause or contribute to exceedances of WQOs; <br /> and (3) implement long-term, managed restoration of impaired water bodies. <br /> 92. For the SCP, the Central Valley Water Board will issue a Notice to Comply <br /> requiring the Discharger to submit a Notice of Intent specifying whether the <br /> Discharger intends to participate in the Conservation Salinity Permitting <br /> Approach or the Alternative Salinity Permitting Approach (i.e., Prioritization & <br /> Optimization (P&O) Study). In the interim, this Order requires the Discharger to <br /> maintain existing salt discharge levels and prohibits the Discharger from causing <br /> or contributing to condition of pollution and/or nuisance, as those terms are <br /> defined in Water Code section 13050. After receiving the Discharger's Notice of <br /> Intent to participate in the SCP, the Central Valley Water Board will update these <br /> WDRs to reflect the requirements of the Discharger's chosen regulatory pathway. <br /> 93. For the NCP, the Facility falls within the San Joaquin Valley— Eastern San <br /> Joaquin Basin 5-022.01, a Priority 2 Basin. Notices to Comply for Priority 2 <br /> Basins will be issued in 2023-2024 and will require the Discharger to submit a <br /> Notice of Intent specifying whether the Discharger intends to comply with the <br />
