DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-OOXX 33 <br /> FORWARD, INC. <br /> FORWARD LANDFILL <br /> SAN JOAQUIN COUNTY <br /> Environmental Impact Report (SEIR) in connection with its issuance of a <br /> SCH#2008052024. For purposes of the EIR, the "project" includes the following <br /> pertinent elements: <br /> a. Improvements to Intersection 11, Arch Road/Austin Road, Southbound; <br /> b. Reduce the impact of increased truck noise to a level that would be less <br /> than significant, if residences request funding and implement the <br /> soundproofing measures; <br /> C. Reduce cumulatively significant air quality impacted in the project area; <br /> and <br /> d. Reduce the visual effects of the project caused by an increase in height <br /> and mass of the proposed project. <br /> 119. This Order implements all applicable mitigation and monitoring measures <br /> specified in the EIR. <br /> Other Regulatory Matters <br /> 120. This Order is issued in part pursuant to Water Code section 13263, subdiv. (a), <br /> which provides as follows: <br /> The regional board, after any necessary hearing, shall prescribe <br /> requirements as to the nature of any proposed discharge, existing <br /> discharge, or material change in an existing discharge..., with <br /> relation to the conditions existing in the disposal area ... into which, <br /> the discharge is made or proposed. The requirements shall <br /> implement any relevant water quality control plans that have been <br /> adopted, and shall take into consideration the beneficial uses to be <br /> protected, the water quality objectives reasonably required for that <br /> purpose, other waste discharges, the need to prevent nuisance, and <br /> the provisions of [Water Code] Section 13241. <br /> 121. This Order implements the Central Valley Water Board's Basin Plan, which <br /> designates beneficial uses for surface water and groundwater and establishes <br /> WQOs necessary to preserve such beneficial uses.2 (Wat. Code, section 13241 <br /> et seq). <br /> 2 Designated beneficial uses to surface water and groundwater are discussed in Finding 38 and <br /> Finding 41, respectively. <br />
