DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-OOXX 34 <br /> FORWARD, INC. <br /> FORWARD LANDFILL <br /> SAN JOAQUIN COUNTY <br /> 122. For the purposes of California Code of Regulations title 23 (Title 23), <br /> section 2200, the Facility has a threat-complexity rating of 1-A, where: <br /> a. Threat Category "1" reflects waste discharges that can cause long-term <br /> loss of receiving water beneficial uses (e.g., drinking water supply loss, <br /> water-contact recreation area closures, or posting of areas used for <br /> spawning/growth of shellfish or migratory fish); and <br /> b. Complexity Category "A" reflects (1) any discharge to toxic wastes, (2) any <br /> small volume discharge containing toxic waste, (3) any facility having <br /> numerous discharge points and groundwater monitoring, or (4) any Class I <br /> WMUs. <br /> 123. This Order regulates the discharge of cannery wastes to land, which could result <br /> in water quality impacts for nearby disadvantage communities and includes an <br /> alternative compliance path that allows time to come into compliance WQOs for <br /> salt and nitrate, pursuant to the SCP and NCP, respectively, when the <br /> Discharger enrolls in the programs. The Central Valley Water Board has <br /> satisfied the outreach requirements set forth in Water Code section 189.7 by <br /> conducting outreach in affected disadvantaged communities. Pursuant to Water <br /> Code section 13149.2, the Central Valley Water Board reviewed readily available <br /> information and information raised to the Board by interested persons concerning <br /> anticipated water quality impacts in disadvantaged or tribal communities resulting <br /> from adoption of Order; the Board also considered environmental justice <br /> concerns within the Board's authority and raised by interested persons with <br /> regard to those impacts. The Board anticipates that the issuance of this Order <br /> will result in water quality impacts and environmental justice concerns within the <br /> scope of the Board's authority. The Discharger must submit a Notice of Intent <br /> (see Table 11, Item 9) and pursue a mitigation option for salinity and possibly <br /> nitrate. It is anticipated that increasing salinity in the cannery waste land <br /> application area is degrading the groundwater quality and impacting the <br /> surrounding disadvantaged community. The Board has identified the following <br /> measures available and within the scope of its authority to address the impacts of <br /> the permitted cannery waste land application to the nearby disadvantaged <br /> communities of San Joaquin County: 1) enroll SCP and NCP and 2) not exceed <br /> the nitrogen loading on the LAA as per Discharge Specification B.11 and CAO <br /> R5-2017-0703. <br /> Reporting Requirements <br /> 124. This Order is also issued in part pursuant to Water Code section 13267, subdiv. <br /> (b)(1), which provides that: <br />
